Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal use of child labour or human trafficking offences. The bidder must also have no tax or social security contribution arrears; the threshold for tax and contribution arrears is EUR 0, subject to statutory exceptions, including deferred debts and tax arrears below EUR 100.
The exclusion grounds also cover bankruptcy, liquidation or other insolvency proceedings, an agreement with creditors, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, prior involvement in preparing the procurement, and substantial or repeated breaches of previous public contracts resulting in termination, damages or another sanction. The bidder must not have submitted false information, failed to provide required information or documents, or attempted to improperly influence the contracting authority’s decisions.
The bidder must also confirm compliance with environmental, social and labour-law obligations and confirm that there are no grounds for exclusion related to enabling the employment of foreign nationals staying in Estonia without a lawful basis, international sanctions or conviction for a tax offence. If any exclusion ground applies, the bidder must provide the required explanations and, where applicable, evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The tender documents do not state separate specific requirements concerning the bidder’s financial capacity, minimum turnover, previous experience, key personnel or reference contracts. A bidder may submit a tender for up to three lots.
For each selected lot, the tender must be prepared on the basis of the technical specification in Annex 1, and a participation application must be submitted using Annex 3 Form II. Where a joint tender is submitted, the bidders must provide the power of attorney for the joint bidders and the confirmation of joint and several liability using Annex 3 Form I. The tender price must be submitted in euros, exclusive of VAT, using the prescribed price-form structure. The price must include all delivery and unloading costs, and the quoted unit prices are final.
The bidder must confirm that the tender complies with the procurement documents and must explain equivalence and provide supporting evidence where the proposed product differs from a referenced standard, label, product or other technical basis. An Excel-format tender corresponding to the technical specification in Annex 1 and the required product samples must be submitted. Samples are not required for products that have been used at Tartu University Hospital under a contract between the bidder and the contracting authority during the two years preceding publication of the contract notice. In all other cases, samples must be delivered no later than the tender submission deadline to L. Puusepa 8, 50406 Tartu, room E111, or sent by post to the same address. Samples must be marked with the tender title, reference number 315481, lot number and bidder’s name; they will not be returned. The contracting authority may request additional samples for practical testing, which must be delivered within three working days; failure to do so may result in the tender being declared non-compliant.
If a product has been placed on the market as a medical device, it must bear the CE marking in accordance with Regulation (EU) 2017/745. A product placed on the market as a biocidal product must comply with Regulation (EU) No 528/2012 and have been lawfully placed on the European Union market. Certificates and declarations of conformity, or copies thereof, must be submitted with the tender. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from a sanctioned region.
