Compliance requirements

The bidder must confirm that neither the bidder nor its representatives or members of its management or supervisory bodies have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking offences. The bidder must also have no outstanding tax or social security payment debt; for tax debt, the notice specifies a threshold of EUR 100, except where the debt has been deferred. The exclusion grounds also cover breaches of environmental, social and labour-law obligations, bankruptcy or liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, previous material contract breaches, and the submission of false information or failure to provide required documents. The notice also addresses unlawful employment of foreign nationals, compliance with international or Estonian sanctions, and convictions for tax offences. The bidder must provide the required declarations in the ESPD and, where necessary, supporting evidence; measures taken to restore reliability may be described where applicable.

Qualification criteria and exclusion grounds

The bidder must have a notice of economic activity registered in the Estonian Register of Economic Activities for owner’s supervision and for the registered activity of general construction. The service must be provided with a responsible owner’s supervision specialist for general construction who holds a Level 7 Chartered Construction Engineer qualification, specialisation in building construction and professional field of owner’s supervision. The bid must include the responsible specialist’s name and personal identification code; the contracting authority will verify the qualification in the professional register. Joint bidders must appoint an authorised representative and attach a power of attorney for the joint bidders to the bid. The bid must comply with all conditions set out in the tender documents; conditional bids are not permitted. The tender price must be submitted using the structure specified on the award criteria and measurable indicators sheet.
