The bidder must confirm that neither it nor its representatives, management or supervisory body members are subject to the exclusion grounds specified in the procurement. The grounds checked include, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour and human trafficking. The contracting authority also checks breaches of tax and social security payment obligations, allowing an unlawfully staying foreign national to work in Estonia, and the applicability of international or Estonian sanctions. Where relevant, the bidder must provide information on convictions, the duration of exclusion and measures taken to restore its reliability. The bidder must be able to prove payment of taxes and social security contributions or proper fulfilment of those obligations.

The bidder must be registered in the required business register of its country of establishment and be able to provide registration details as evidence. To demonstrate technical and professional capacity, the bidder must have properly completed at least 2 street-lighting construction contracts during the 36 months preceding the start of the procurement, using LED lights and installing at least 50 lights per contract. For each contract, the ESPD must include the project name, location, contract start and end dates, and the client’s name and contact details. Proper performance may be verified, for example, by a client confirmation letter or an enquiry sent to the client. The works must involve an electrical engineer with at least professional qualification level 6 and experience in at least 2 outdoor-lighting construction projects accepted by the contracting authority; the bidder must submit the engineer’s qualification document and CV with the tender. The tender must comply with the procurement documents, be unconditional and follow the required pricing structure. Where necessary, explanations and evidence of equivalence must be submitted. In the case of a joint tender, a power of attorney from the joint tenderers must be included.
