Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant convictions of the bidder or its management, supervisory or authorised representatives for participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the unlawful employment of foreign nationals or paying them below the statutory wage; unlawful use of child labour or trafficking in human beings; and outstanding state taxes, duties, environmental charges or social security contributions. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier procurement contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information about compliance with qualification requirements or failed to submit required information or additional documents. Entities established or resident in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components produced in or originating from those countries may not be installed or used; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the procurement during the 60 months preceding the commencement of the procurement. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including their performance periods, the contracting party’s representative and contact details, and, for public contracts, the relevant reference numbers. Evidence of proper performance must be submitted at the contracting authority’s request unless the information can be obtained from public or private databases without significant expense. The team must include a person with valid switching rights for switching operations in a 0.22–20 kV electricity network, who must be registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage-only works, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required where applicable. The team must also include a person responsible for the work operation, registered in the partner portal before the tender submission deadline, and a person managing electrical works with valid A competence and/or a qualification corresponding to at least level 6 under the Vocational Qualifications Act. The latter must hold the relevant evidence at the time of tender submission and be registered in the partner portal before the deadline. The tender must include the completed price table with all unit-price fields filled in and must comply with all procurement documents. Conditional tenders or tenders containing additional conditions are not allowed. The bidder must provide the names, positions and contact details of the contract signatory or signatories and the contract-performance contact person; a power of attorney must be included where signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. The tender must also state and justify any trade secrets, but the tender price and other legally non-confidential evaluation-related figures may not be classified as trade secrets.
