Compliance requirements

The bidder, or any member of its representative, management or supervisory body, procurator, or other person with authority to represent or control it, must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment, violating the employment conditions of a foreign national, unlawful use of child labour, or trafficking-related offences. The bidder must not have outstanding national tax, payment or environmental-fee debts, or tax or social-security payment debts under the law of its country of establishment. The contracting authority may also exclude a bidder that has substantially or repeatedly breached important terms of previous public contracts, or that has submitted false information regarding compliance with the qualification requirements or failed to submit required information or documents. The bidder must confirm that none of these exclusion grounds apply. Companies established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components produced in or originating from Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin as evidence.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the tender. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and procurement reference numbers where applicable. The contracting authority may also request evidence of proper performance. The bidder must have an employee with valid switching rights for the switching operations required for the works in a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before tenders are opened. For works limited to 0.22–1 kV, at least low-voltage switching rights are required; in other cases, both low-voltage and medium-voltage switching rights are required. The bidder must also have a person responsible for work operations with valid rights, registered in the same portal before tenders are opened. The person managing the electrical works must hold valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act, possess the relevant evidence, and be registered in Elektrilevi’s partner portal before tenders are opened. The tender must comply with all tender-document requirements, be unconditional, and include a properly completed price table with every unit-price field filled in. The bidder must provide the details of the contract signatory and the contact person for contract performance, together with a power of attorney where necessary.
