Compliance requirements
The bidder may be excluded for relevant convictions involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or suspended business activity; serious professional misconduct; agreements distorting competition; an unresolved conflict of interest or an unfair advantage from involvement in preparing the procurement; serious or repeated failures under previous contracts; false or omitted information, failure to provide requested documents, or attempts to improperly influence the procurement; and specified national grounds, including enabling unlawful employment of a foreign national, international sanctions, or tax offences. Where permitted, the bidder may submit evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have completed at least three contracts equivalent to the procurement within the 36 months preceding the start of the procurement. Each equivalent contract must have involved providing at least three vehicle-towing services. The bidder may provide a list of contracts, including their dates, values and the other contracting party’s name and contact details. Only services delivered and accepted during the reference period count; for framework agreements, completed orders or projects may be used. If requested, additional information or evidence that is not readily available in public registers must be provided within five working days.
The bidder must have at least eight tow trucks available for the service: at least five capable of towing vehicles with a gross weight of up to 3,500 kg, at least two capable of towing vehicles with blocked wheels and a gross weight of up to 3,500 kg, and at least one capable of towing vehicles with a gross weight of up to 40,000 kg. The bidder must submit vehicle details using the contracting authority’s form and copies of the vehicle registration documents. For vehicles not owned by the bidder, a confirmation from the other company authorising their use must also be submitted.
The tender must include a telephone number available around the clock for placing towing orders and a price breakdown using the contracting authority’s prescribed form. By submitting a tender, the bidder confirms compliance with the procurement documents; conditional tenders are not permitted. Joint bidders must appoint an authorised representative and provide the required authorisation. The bidder must also provide the required confirmation concerning restricted Russian subcontractors and suppliers.
