Compliance requirements
The bidder must confirm that neither it nor its representatives are subject to relevant convictions, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Exclusion grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or comparable proceedings; suspended business activities; serious professional misconduct; competition-distorting agreements; unmanageable conflicts of interest; improper involvement in preparing the procurement; serious or repeated failures under previous public contracts; false or misleading information, withheld information or failure to provide requested documents; and attempts to obtain confidential information or improperly influence the contracting authority. The bidder must also declare that it is not subject to applicable national exclusion grounds, including relevant unlawful employment offences, international sanctions, tax offences or local tax debts where applicable.
Participation is prohibited for businesses established or resident in Russia or Belarus, including entities whose resources the bidder relies on. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian persons or entities, more than 50% owned by such persons or entities, or acting on their behalf or instructions. Where an exclusion ground applies, the bidder may provide evidence of remedial measures if permitted for this procurement.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 500,000 in each of the last two financial years completed before the procurement began. The bidder must also have properly performed at least one relevant service contract during the 36 months before the procurement began: maintenance of the electrical installation of a building with more than 3,000 m² of enclosed net floor area for at least six consecutive months. The contract may still be ongoing, provided that this minimum period has been properly completed. The bidder must provide a list of relevant contracts with descriptions, values, dates and client details, including contact information and, where applicable, procurement reference numbers.
For each mini-competition, the bidder must provide the qualified specialists required by section 3.1 of the technical description, or equivalent specialists, and submit their names and signed confirmations that they will participate in contract performance. A joint bid must include a power of attorney appointing one member to represent the group. The bid must be unconditional, comply with the procurement documents and follow the specified price-submission structure; the price schedule in Annex 4 must be submitted. Where equivalence is relied upon, the bidder must explain it and provide supporting evidence. The bidder must identify any information claimed as a trade secret and justify that claim; prices and other specified evaluation figures may not be classified as trade secrets. The bidder must also provide the names and personal identification numbers of authorised or management representatives not visible in the public procurement register, or confirm that there are none.
