Compliance requirements
The bidder must declare whether it or its relevant managers, representatives or supervisory personnel have, within the applicable period, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. The grounds also cover breaches of tax or social security payment obligations; tax debts below EUR 100 or debts whose payment has been rescheduled are treated as described in the tender-pass conditions.
Other grounds include breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets by a liquidator or court, suspended business activity, or a comparable situation; serious professional misconduct; agreements with other businesses intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; and serious or repeated failures under previous public contracts resulting in early termination, damages or comparable sanctions. A bidder may also be excluded for false or misleading information, withholding required information, failure to provide requested supporting documents, or seeking confidential information or improperly influencing the procurement decision.
National grounds include enabling a foreign national to work without a legal basis or in breach of employment conditions, being subject to an applicable international or Estonian government sanction, and relevant tax offences. Where legally available, the bidder may provide information about measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment or an equivalent register. The contracting authority will check the registration of Estonian companies itself. A foreign bidder must provide a reference to the competent register or a certificate apostilled or legalised and no more than one month old on the bid submission date.
The bidder’s average annual net turnover for 2023–2025 must be at least EUR 150,000, corresponding to a stated minimum total of EUR 450,000 for the period.
During the 60 months before the procurement began, the bidder must have constructed and/or reconstructed a total of at least 1.0 km of public water supply and/or sewerage pipelines under at least one contract. The bidder must list the relevant completed works in the European Single Procurement Document. If requested by the contracting authority, the successful bidder must provide evidence that the works were properly performed. A contract awarded earlier may count if the works were completed within the specified 60-month period.
The bidder must have a quality management system certified to ISO 9001 or an equivalent system, and an environmental management system certified to ISO 14001 or an equivalent system. A consortium may rely on the certified system of one consortium member, provided the other members undertake to follow that system during contract performance. Reliance on another company's ISO certificate is not permitted. A certificate copy or other evidence must be provided.
The contract must be managed by a Project Manager/Contractor’s Representative holding a professional qualification as a certified water supply and sewerage engineer, specialising in external water supply and sewerage, level 7, in construction management, or an equivalent or higher level 8 qualification. The bidder must provide the person's name and qualification details. If the key person's employer is not part of the bid, the person's consent to participate must also be included. A foreign bidder must provide evidence of the qualification or its equivalence.
The bid must include a signed bid annex (Form PII), follow the required price structure, and include the completed bill of quantities for Part IV. Joint bidders must appoint an authorised representative and provide the relevant power of attorney. The bidder must confirm that the bid complies with the procurement documents, including that any claimed equivalence is explained and supported by evidence. It must also confirm that it will not use a subcontractor who would have to be replaced under the stated subcontractor rules, and that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. Any information claimed as a trade secret must be identified and justified; bid prices and other specified evaluation-related figures may not be classified as trade secrets. No specific award-scoring details are included in the provided documents.
