Compliance requirements

The bidder and its management, administrative or supervisory body members and representatives are subject to exclusion checks. Grounds include final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or related activity, money laundering or terrorist financing, and the illegal use of child labour or human trafficking. Failure to pay taxes or social security contributions is also covered; for tax debt, the stated exception applies to debt below EUR 100 or debt for which payment has been deferred. Other possible grounds include bankruptcy, insolvency, liquidation or similar proceedings, assets being administered by a liquidator or court, suspended business activity, or an arrangement with creditors. The checks also cover serious professional misconduct; agreements distorting competition; an unavoidable conflict of interest; involvement in preparing the procurement in a way that creates an undue advantage; early termination or sanctions resulting from a material breach of a previous contract; provision of false information, failure to provide information or required documents, and improper acquisition of confidential information. Grounds further include breaches of environmental, social or labour obligations; enabling a foreign national residing unlawfully in the country to work; international sanctions; conviction for tax offences; and restrictions on the right to participate in the procurement. Where applicable, a bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must submit a technical tender identifying the system’s manufacturer, model and technical parameters so that compliance with the technical specification can be assessed. Any proposed equivalence must be explained and supported by evidence where necessary. The system must have a warranty of at least 12 months. During the warranty period, technical support must be available on working days by email and telephone, with a response to the buyer’s notice within 48 hours on working days. The bidder must confirm the warranty period and provide technical support contact details. The total tender price must include transport and delivery to the University of Tartu Institute of Chemistry at Ravila 14a, 50411 Tartu, including customs and other charges, on-site installation, operational testing and initial training for the buyer’s representatives. The tender must remain valid for at least three months from the submission deadline. If awarded the contract, the bidder must return the signed contract within five calendar days of receiving the contract signed by the buyer. The bidder must confirm that it has reviewed and accepts the tender conditions and will perform the contract for the price stated in its tender. If the signatory’s authority is not evident from the relevant register, a power of attorney must be provided. For a joint tender, the bidders must submit a power of attorney, confirmation of joint and several liability, and ESPD documents for each joint bidder. The bidder must also identify, by name and personal identification number, any persons authorised to represent, make decisions for or control it whose details are not available in the relevant register, or confirm that there are no such persons. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate in a sanctioned region; that more than 50% of their ownership is not held directly or indirectly by Russian citizens, residents or entities established in Russia; and that the bidder does not represent or act on the instructions of such persons or entities. Subcontractors, suppliers and entities whose capacity is relied upon must not be covered by these restrictions if they account for more than 10% of the contract value. The buyer may request relevant ownership, beneficial-owner, subcontractor and supplier details and evidence. The documents reviewed do not specify separate turnover, previous-experience or staffing qualification thresholds. Award criteria are not detailed in the available text and should be checked in the tender documents.
