Compliance requirements
The bidder may be excluded for relevant convictions of the company or its management or representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Exclusion may also apply for breaches of tax or social-security payment obligations; bankruptcy, insolvency, liquidation or comparable proceedings; suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; serious or repeated breaches of earlier contracts resulting in termination or comparable sanctions; or false, misleading or withheld information, failure to provide requested documents, or improper attempts to influence the procurement or obtain confidential information. Breaches of environmental, social or labour obligations are also grounds for exclusion.
National grounds include enabling the unlawful employment of a foreign national, a contract award that would breach international or Estonian sanctions, relevant tax offences, and any applicable restriction on the bidder’s right to participate. The notice sets the threshold for tax and social-security arrears at EUR 0; it also notes that an Estonian tax-debt certificate is not issued where the debt is below EUR 100 or payment has been rescheduled. Where legally permitted, the bidder may provide evidence of measures taken to restore its reliability.
