Compliance requirements
The bidder may be excluded for relevant final convictions of the bidder or its representatives within the applicable period, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Grounds also include failure to pay taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspension of business or comparable situations; serious professional misconduct; anti-competitive agreements; an unresolved conflict of interest; involvement in preparing the procurement where an advantage cannot otherwise be remedied; significant or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, withholding required information or documents, or improperly seeking confidential information. National grounds include enabling a foreign national to work without legal grounds or in breach of employment conditions, being subject to international sanctions, tax-related criminal offences, and any applicable restriction on a bidder’s right to participate. For tax and social security debts, the notice gives a threshold of EUR 0; however, Estonian tax authorities do not issue a debt certificate where the relevant debt is below EUR 100 or payment has been deferred. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
