Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant convictions of the bidder or its representatives for criminal organisation, breach of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment or employment-related violations, unlawful use of child labour or trafficking, and the existence of tax, payment or environmental-charge arrears. Exclusion also applies to persons subject to international sanctions where contract award would breach those sanctions. The contracting authority may also exclude a bidder for breaches of environmental, social or labour-law obligations; insolvency, liquidation or comparable circumstances; serious professional misconduct; anti-competitive agreements or coordinated conduct; an unavoidable conflict of interest; an unfair advantage arising from involvement in procurement preparation; serious or repeated breaches of previous public contracts; false or missing qualification information; attempts to improperly influence the contracting authority or obtain confidential information; tax-related convictions; or lack of the legal right to submit a tender. The bidder must provide the required confirmations. Companies established or resident in Russia or Belarus may not participate. Materials, equipment, goods and components originating from or produced in Russia or Belarus may not be installed or used during performance; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 250,000 in each of the last three completed financial years. The bidder must provide extracts from the relevant annual accounts, unless the information is publicly available to the contracting authority from a register. At least six months must have elapsed since the end of the latest completed financial year by the tender submission date. During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement. At least one of these contracts must have had a value of at least EUR 80,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting parties’ details and the client representative’s telephone number and email address; public procurement contracts must also include their reference numbers. Evidence of proper performance must be provided upon request where the contracting authority cannot obtain it without significant expense. The bidder must have a person with valid switching rights for work-related switching operations in 0.22–20 kV electricity networks, including operational switching, isolation and earthing, re-energisation and restoration of the normal network configuration, excluding regional and distribution substations. This person must be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person responsible for the work operation, registered in the same portal, and a person managing electrical works who has valid A competence or a qualification corresponding to at least level 6 under the Estonian Vocational Qualifications Act and is registered in the portal before tenders are opened. The tender must comply with all procurement document requirements and may not contain additional or conditional terms. The price must be submitted using the required price table, with all unit-price fields completed. The bidder must provide the name, position and contact details of the contract signatory and the contract-performance contact person, together with evidence of signing authority; a power of attorney must be added where the authority does not arise from the articles of association. The bidder must also identify and justify any trade secrets or state that the tender contains none.
