Compliance requirements

A bidder will be excluded if any exclusion ground under section 95(1) or section 95(4)(8) of the Estonian Public Procurement Act applies. The grounds include a final conviction of the bidder or a member of its representative, management or supervisory body for corruption, terrorism-related offences, fraud, money laundering or terrorist financing, unlawful use of child labour or human trafficking, or participation in a criminal organisation. Convictions within the previous five years or an exclusion period that remains in force are relevant. Exclusion grounds also include unpaid taxes or social security contributions, and a conviction for enabling a foreign national staying in the country unlawfully to work or for breaching the conditions governing a foreign national’s employment in Estonia. Contract award must also not violate international sanctions or sanctions imposed by the Republic of Estonia. The bidder must confirm that none of the exclusion grounds applies. The contracting authority will not award the contract to a bidder to which a ground applies. First-tier subcontractors will be checked, and the bidder must confirm that it will not use a subcontractor that must be replaced under the law. Subcontractors in the second and subsequent tiers will not be checked, and subcontractors are not required to submit an ESPD.

Qualification criteria and exclusion grounds

The bidder must have at least 7 years of experience in building or renovating medium-voltage substations. During the 60 months preceding the tender submission deadline, the bidder must have properly completed at least two construction contracts similar to this procurement. The contracts submitted as references must collectively demonstrate experience installing at least one switchgear unit rated at 10 kV or higher with a nominal current of at least 630 A, and making a joint in at least one medium-voltage cable or terminating a cable for connection to equipment. The total value of each reference contract must be at least EUR 100,000 excluding VAT. For each contract, provide its title and a brief description, the client’s name, contract value, performance period and the client’s contact details. The contract must be performed with a site manager or project manager holding either an electrical work competence certificate, class A, or a level 7 electrical engineer professional qualification that authorises them to manage the contract works. The specialist must have at least 7 years of experience in building or renovating medium-voltage substations. Submit a copy or number of the competence certificate and details of the required experience. The bidder must submit the completed price schedule using the buyer’s form and manufacturer’s information sheets, technical data sheets or equivalent documents for the proposed equipment, enabling verification against the technical requirements. The bid must state the equipment delivery period from the date of order and include a works schedule showing the expected delivery period and planned period for carrying out the works. If the contractor’s personnel will perform medium-voltage switching, provide evidence that they hold switching authorisation issued by Elektrilevi for equipment of at least 10 kV. List any subcontractors planned for contract performance, stating each subcontractor’s name and the part of the works or activities assigned to it, or state that no subcontractors will be used. For a joint bid, submit the joint bidders’ power of attorney. The bid must comply with the tender documents; conditional bids are not permitted. Any information claimed as a trade secret must be justified, and the bid price and figures relating to the award criteria may not be designated as trade secrets. Where equivalence is offered, explain it and provide supporting evidence. The bidder must confirm that the proposed goods are not subject to international sanctions and do not originate from a sanctioned region, and that it will not use a subcontractor that must be replaced under the law.
