Compliance requirements

The bidder must confirm that none of the exclusion grounds specified in § 95(1) of the Estonian Public Procurement Act apply. The contracting authority may also exclude a bidder where an exclusion ground under § 95(4) applies and may verify the grounds in accordance with § 96. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities more than 50% directly or indirectly owned by such persons or entities, or representatives or persons acting on their instructions. A tender leading to a contract that would be void under § 7(1) of the Estonian International Sanctions Act will be rejected. The bidder must also confirm that any goods offered are not subject to international sanctions and do not originate from sanctioned regions. The tender must state which information constitutes a trade secret and provide reasons; the tender price and other prohibited price-related evaluation figures may not be designated as trade secrets.

Qualification criteria and exclusion grounds

The bidder must have completed at least two contracts during the 36 months preceding the start of the procurement for the provision of repair or installation works for energy-generation or energy-distribution equipment. Each contract must have had a value of at least EUR 100,000 excluding VAT and must have included pressure-equipment welding and related mechanical fitting works. The bidder must submit the list of contracts on Form I, including their values, dates and the other contracting parties. For contract performance, the bidder must be able to use a team with the required experience and qualifications: one welding coordinator, one person responsible for pressure-equipment works, at least six qualified welders and at least six qualified mechanical fitters. Team members must be identified on Form II and copies of documents proving their competence must be submitted. The contracting authority may request additional evidence. The bidder must submit the price on Form III in euros excluding VAT. The total amount on the form must match the total amount entered in the tender evaluation information, and the price must include all costs necessary to achieve the purpose of the procurement. The tender must comply with all tender documents; conditional tenders are not allowed. Where applicable, a joint tender must include a power of attorney appointing an authorised representative of the joint tenderers.
