Compliance requirements

The bidder must confirm that neither it nor its representatives are subject to exclusion grounds arising from final convictions within the relevant five-year period or an ongoing exclusion period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must not have outstanding tax or social security payment obligations. The notice states that tax debt below EUR 100 or tax debt subject to a payment schedule is treated in accordance with the applicable tax rules. The bidder must not be in bankruptcy, liquidation, insolvency proceedings or a comparable situation; have suspended business activities; have seriously breached professional conduct rules; entered into arrangements that distort competition; have an unavoidable conflict of interest; participated improperly in preparing this procurement; or have had a previous public contract terminated early or resulted in damages, a price reduction or a contractual penalty because of a material or repeated breach. The bidder must also not have submitted false or misleading information, withheld required information or documents, improperly sought confidential information or attempted to influence the contracting authority. Additional national exclusion grounds concern enabling an unlawfully residing foreign national to work, being a subject of an international sanction, and, where applicable, convictions for tax offences or local tax debt under the applicable national rules. The bidder must provide the required declarations and supporting information, and must confirm that the proposed subcontractors do not give rise to a prohibited exclusion ground. Self-cleaning evidence may be submitted where permitted by the procurement rules or tender documents.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least one construction contract during the 60 months preceding the tender notice involving road or street construction together with the construction or reconstruction of water, wastewater or stormwater drainage. The reference contract must include at least 9,000 m² of asphalt paving. The bidder must provide the reference project, procurement reference number, client and contact details, performance period and asphalt paving quantity. Client confirmation letters may be submitted with the bid and will be requested from the successful bidder; a confirmation is not required where the client was Viljandi City Government. The bid must also include the required compliance documents and confirmations, including the joint tender authorisation where applicable, the bidder’s declarations and data, and the required bid guarantee. The bid must follow the prescribed price structure and cost schedule, may not be conditional, and must demonstrate compliance with the procurement documents. Where an equivalent standard, product or technical solution is offered, its equivalence and supporting evidence must be explained. The bidder must confirm that it will not engage a subcontractor subject to mandatory replacement under the applicable public procurement rules and that the bidder and its subcontractors are not domiciled or resident in the Russian Federation or the Republic of Belarus.
