Compliance requirements
The bidder must confirm that none of the exclusion grounds under § 95(1), points 1–3 and 5 of the Estonian Public Procurement Act, taking account of § 95(2), apply. The bidder must not be bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, have suspended business activities or be in an equivalent situation under the law of its country of establishment.
The bidder must not have outstanding national taxes, duties, environmental charges, tax debts or social security contribution debts under the law of its country of establishment. The bidder must confirm that its employees’ average wage during the six-calendar-month reference period was more than 70% of the average wage in the relevant field for the same period. The bidder must prove this with an extract from the Estonian Tax and Customs Board or, for a foreign bidder, evidence from an equivalent competent authority. In a joint tender, each joint bidder must provide the evidence.
The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. The contracting authority will check the exclusion grounds for the successful bidder and, in a joint tender, for every joint bidder.
Qualification criteria and exclusion grounds
The bidder must be registered in the Estonian Register of Economic Activities for construction activities covering general construction, indoor climate systems, and building or associated water supply and sewerage systems. For electrical works, the bidder must also have the required registration for constructing and installing electrical installations. Foreign bidders may provide equivalent evidence.
The net turnover in the financial year preceding the start of the procurement procedure must be at least twice the estimated contract value excluding VAT. The element manufacturer involved by the bidder, whose main business is the manufacture of prefabricated wooden buildings and their elements, must have achieved total net turnover of at least half of the estimated contract value excluding VAT during the three consecutive financial years preceding the procedure, namely 2024, 2023 and 2022.
During the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. The project must have involved construction, extension or full-building reconstruction as the main contractor and must have included construction or reconstruction of the building’s load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. Details of the building, timing, value, scope and included works must be submitted.
The involved element manufacturer must, during the preceding 60 months, have produced façade or roof reconstruction elements for at least three equivalent existing or new buildings. The buildings must generally have been at least three storeys high and equipped with indoor climate systems; where the procured apartment building has fewer than three storeys, a building with the same number of storeys may be considered equivalent. Details of all three works must be provided. The element manufacturer must also hold a valid European Technical Assessment or an equivalent document, with a copy or other evidence submitted.
The team must include:
- a project manager with at least a level 6 civil engineering qualification specialising in building construction and construction activity management, or a level 6 construction manager qualification specialising in general construction;
- a site manager with at least a level 5 construction works manager qualification specialising in general construction;
- a ventilation and heating systems specialist with at least a level 6 heating, ventilation and cooling engineer qualification with the specified construction-management competences, or a level 6 construction manager qualification specialising in indoor climate systems;
- a water supply and sewerage systems specialist with at least a level 6 water supply and sewerage engineer qualification with construction-management competence, or a level 6 construction manager qualification specialising in building water supply and sewerage systems;
- for electrical works, a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations; and
- an authorised level 7 architect responsible for ensuring compliance of the construction project with the requirements of the New European Bauhaus.
Foreign bidders may propose persons with equivalent competence. The names and certificate or qualification numbers of the nominated persons must be submitted.
The bidder must have a construction-sector quality management system meeting at least EVS-EN ISO 9001 or equivalent requirements, and an environmental management system meeting at least EVS-EN ISO 14001 or equivalent requirements. Copies of the certificates or evidence of equivalent systems must be provided. A performance-period guarantee amounting to 5% of the contract value must be available for the entire construction period; it may also be provided by depositing the corresponding amount in the contracting authority’s or a notary’s account.
