Compliance requirements

A bidder will be excluded if the bidder or a person with management, supervisory or representation authority has been convicted of participation in a criminal organisation, corruption, fraud, a terrorism-related offence, money laundering or terrorist financing; enabling the employment of an illegally resident foreign national or violating the conditions for employing a foreign national in Estonia; or unlawful use of child labour or an act related to human trafficking. Exclusion also applies where the bidder has outstanding state tax, payment or environmental charge debts, tax or social security payment debts, or where awarding the contract would breach an international or Estonian sanction. For bidders registered in Estonia, the contracting authority will verify the information through register inquiries; foreign bidders must provide certificates from the competent authorities in their country of establishment where required. The absence of exclusion grounds must also be confirmed separately for each member of a joint tender. The bidder must disclose any possible conflict of interest or competitive advantage arising from participation in preparing the procurement or from links with the contracting authority. The same checks may apply to named subcontractors and entities whose resources the bidder relies on.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or an equivalent register in its country of establishment; where necessary, a foreign bidder must provide a valid registration certificate or equivalent evidence. During the 36 months preceding the launch of the procurement, the bidder must have properly performed one or more road transport service contracts for goods or bulk materials with a total value of at least EUR 100,000 excluding VAT. This must be demonstrated using the “List of contracts” form, stating the contract subject, value, performance period, and the other contracting party’s name and contact details. The information must clearly show that the contracts concerned road transport services for goods or bulk materials. The tender must be unconditional and comply with the procurement documents. The completed tender form must state the basic tariff in euros per tonne excluding VAT and the guaranteed daily transport capacity, which must be at least 500 tonnes per day. Every entity actually transporting waste bearing waste code 02 03 04, including subcontractors, must hold a valid Environmental Board waste management registration by the tender submission deadline. The registration must cover the transport of municipal waste in Ida-Viru County and permit the transport of waste code 02 03 04. The tender must identify all entities carrying out the waste transport, their registration codes and the numbers of their waste management registrations. If subcontractors are used, their names, registration codes, and the size and nature of the subcontracted part must be provided. If the bidder relies on another entity’s resources or references, it must prove that the resources are available, that the entity agrees to make them available, and that they will be used in contract performance; an entity whose references are relied upon must itself perform the contract or the relevant part of it. A power of attorney for joint tenderers must be included with a joint tender. The bidder must disclose any trade secrets and provide reasons for treating the information as confidential. By submitting the tender, the bidder confirms acceptance of all procurement document requirements.
