Summary

The Ministry of the Interior is procuring a research study to analyse and develop a target architecture and governance model for identity-data management across the Ministry's area of government, together with the supporting legal framework. The work must integrate legal, organisational and technical perspectives and produce integrated recommendations. The bidder must describe the research methodology and explain its rationale, the research tasks and expected results, the proposed process, and the authorities or partners to be involved. The bid must include a work plan and schedule detailed at least by month, with at least one interim report at the midpoint of the project, a risk analysis and mitigation plan, a team description, and a research budget with an explanation of how it is calculated. The team must have the specified subject-matter experience, and the relevant lead experts must hold at least a master's degree or an equivalent qualification. The bid must remain valid for at least three months, its price must cover all costs of contract performance, and conditional bids are not permitted. Compliance requirements

The bidder must declare whether it, or any member of its administrative, management or supervisory bodies or person authorised to represent, make decisions for or control it, has been convicted within the past five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. The bidder must also declare whether it has breached tax, social-security, environmental, social or labour obligations; is bankrupt, insolvent, being liquidated, subject to an arrangement with creditors, has assets administered by a liquidator or court, or has suspended its business activities; has committed serious professional misconduct; has entered into agreements intended to distort competition; has an unmanageable conflict of interest; gained an unfair advantage through involvement in preparing this procurement that cannot be avoided by other means; or seriously or repeatedly failed to perform a previous contract, resulting in early termination, damages, a price reduction or comparable sanctions. The bidder must not have submitted false or misleading information, withheld required information or evidence, improperly attempted to influence the procurement, or sought confidential information to gain an unfair advantage. National grounds for exclusion also cover enabling a foreign national to work in Estonia without a lawful basis or in breach of applicable employment conditions, including payment below the legally required wage; being subject to an applicable international or national sanctions prohibition; conviction for tax offences; and restrictions on participation based on the bidder's place of establishment. Outstanding tax or social-security debts may lead to exclusion. The notice gives a threshold of EUR 0, while explaining that in Estonia a tax-debt certificate is not issued for debts below EUR 100, excluding interest not established by an administrative act, or where payment of the debt has been deferred. Foreign bidders are assessed under the rules of their country of establishment. Where permitted, the bidder may submit evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

No minimum turnover, financial-capacity threshold or fixed number of experts is specified. The proposed team must collectively cover the legal, organisational and technical aspects of the study and be able to develop integrated recommendations on identity-data management, target architecture, governance and the legal framework. The team must have: (1) professional or research experience in identity management, data management, national registers, digital identity or data protection; (2) experience in legal analysis and in conducting similar strategic or impact analyses concerning public-sector information systems; and (3) experience in preparing target architectures or reform projects. This experience must be demonstrated through references to previous research or development projects or relevant practical work as an expert. The lead experts with the relevant subject-matter expertise must hold at least a master's degree, or an equivalent qualification, in a field relevant to their role, such as law, information technology, information systems, data management or public administration. Submit team members' signed CVs. For any team member who is not employed by the bidder, include that person's signed consent to participate in performing the contract. The CVs must provide enough detail for the contracting authority to verify the experts' qualifications and experience. Describe each team member's role, responsibilities, qualifications, experience and expertise in the bid, including subcontractors where relevant. The bid description must set out the proposed research methodology and explain why it is appropriate; the bidder's understanding of the research problem, tasks and expected results; the proposed research process and the authorities or partners to be involved; and a schedule and work plan detailed at least by month, including at least one interim report at the midpoint of the project. It must also include a risk analysis and mitigation plan covering both the substantive work and team coordination. Submit the research budget in the required structure with an explanation of how it was calculated. The total research price is binding on the bidder, final for the contracting authority and must cover all costs needed to perform the contract; no additional payments will be made. The bid must remain valid for at least three months after the submission deadline. The bidder must confirm that it has, or can obtain, all intellectual-property rights needed to perform the contract, including rights that must be assigned. Conditional bids are not permitted. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must identify and justify any trade secrets; the bid price and other specified price or evaluation figures may not be classified as trade secrets.
