Compliance requirements
A tenderer will be excluded if any of the exclusion grounds under section 95(1) of the Estonian Public Procurement Act apply. The contracting authority may also exclude a tenderer under section 95(4) and may verify the relevant information in accordance with section 96. The tenderer must confirm that none of the exclusion grounds under section 95(1) apply.
The tenderer may not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons or entities, or representatives or persons acting on their instructions. The goods offered must not be subject to an international sanction or originate from a region subject to sanctions. A tender may be rejected, or the resulting contract may be void, if these conditions are breached.
Qualification criteria and exclusion grounds
The tenderer's total net turnover for the last three financial years completed by the start of the procurement must be at least EUR 1,500,000. The tenderer must provide a confirmation of compliance; the contracting authority may request extracts from the financial statements for those three years if the information is not freely available from public registers.
During the 36 months preceding the start of the procurement, the tenderer must have completed at least one contract worth at least EUR 50,000 excluding VAT for the manufacture, installation or repair of boiler air preheater sections. The tenderer must submit, using Form I, a list of the relevant contracts, including their value, dates and the details of the other contracting parties.
The tender must include Form III, the tender description, together with copies of the required documents, and Form II, the tender price. Prices must be stated in euros excluding VAT, and the total amount in Form II must match the total amount submitted in the procurement environment. Conditional tenders are not permitted. The tenderer must provide copies of the welding coordinator's qualification certificate, the welders' competence certificates and the pressure equipment supervisor's qualification certificate. In the case of a joint tender, a power of attorney appointing an authorised representative must be submitted.
