Compliance requirements
The bidder must confirm that neither the company nor its management, governing or supervisory bodies, authorised representatives or controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour and other forms of human trafficking. The bidder must also have no tax or social security contribution arrears. The threshold for both tax and social security obligations is EUR 0; the notice explains that an Estonian tax authority certificate is generally not issued where the debt is below EUR 100 or payment has been deferred. Previous serious or repeated breaches of public contracts resulting in early termination, damages, price reduction or penalties may also constitute grounds for exclusion. Further exclusion grounds concern enabling an unlawfully staying foreign national to work and being subject to an international sanction. The bidder must provide the required confirmations and, where applicable, details of the conviction, breach, corrective measures and available evidence.
Qualification criteria and exclusion grounds
The notice does not specify separate financial turnover, previous-experience or staffing requirements. The bidder must submit a compliant technical offer for the relevant lot using the prescribed vehicle description form, including the vehicle make, model, trade name or equipment package, price and all requested technical data. The bidder must demonstrate that maintenance, emergency repairs and warranty repairs will be provided by a manufacturer-authorised service partner or by a provider with the manufacturer's written authorisation. The service facility must be located in Tallinn or within 10 km of the Tallinn city boundary. The bidder must provide the service-point location details and the proposed vehicle's scheduled maintenance programme for 60 months or up to 100,000 km. The offer must comply with the procurement documents; if an equivalent product, standard, mark or proof is offered, the equivalence must be explained and supported by evidence. A joint bid requires a power of attorney signed by all joint bidders. The bidder must also confirm that the offered goods are not subject to international sanctions or originating from sanctioned areas, and that restricted Russian subcontractors or suppliers will not account for more than 10% of the contract value.
