Replacement of entrance mats

The bidder must confirm that neither it nor its management, supervisory body members or representatives have been finally convicted within the last five years of offences including participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, illegal child labour or human trafficking. The bidder must not have outstanding tax or social security contribution debts, except where permitted by law because the obligation has been fulfilled or a binding payment arrangement has been concluded. The bidder must not be bankrupt, insolvent, under liquidation or insolvency proceedings, subject to a special arrangement with creditors, under the control of a liquidator or court, or have suspended its business activities. Grounds for exclusion may also include serious breaches of environmental, social or labour law, serious professional misconduct, anti-competitive agreements, conflicts of interest, material breaches of previous public contracts, false statements, or failure to submit required information or documents. The bidder must also confirm that awarding the contract would not breach an international sanction and that it has not committed an offence related to enabling an unlawfully staying foreign national to work. Where an exclusion ground exists, the bidder may submit evidence of remedial measures restoring its reliability where this is permitted in the procedure.

The bidder must have properly completed contracts or orders for replacing entrance mats, or similar or equivalent services, during the 36 months preceding publication of the contract notice, with a combined value of at least EUR 30,000 excluding VAT. Each contract or order counted must have a total value of at least EUR 5,000 excluding VAT, and at least one completed contract or order must be provided. The ESPD must include, for each contract or order, its description, type or name, the bidder’s area of responsibility, value, performance period, contracting client’s name, and the client contact person’s name, email address and telephone number. At the contracting authority’s request, the bidder must provide within a period of at least five working days a written confirmation from the client that the work was properly performed; this confirmation may also be submitted with the tender. If relying on the capacities of another entity or subcontractor, the bidder must submit an ESPD signed by that entity, its consent to reliance, a description of its role and assigned part, and a statement accepting joint responsibility. Only documents in Estonian or English will be accepted. The tender must comply with all tender documents, conditional tenders are not permitted, and the price must be submitted in the required structure both in the evaluation form and in the completed tender form. In a joint tender, a power of attorney for the joint tenderers must be included. The bidder must identify and justify any trade secrets, but may not classify the tender price or numerical figures used for evaluation as trade secrets. The bidder must be established or resident in Estonia, an EU or EEA country, or a country party to the WTO Government Procurement Agreement. The bidder must confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value that are Russian nationals, residents or entities established in Russia, entities more than 50% directly or indirectly owned by such persons or entities, or representatives of or persons acting on their instructions. The bidder must also confirm that the goods offered are not subject to international sanctions and do not originate from a sanctioned region.
