Compliance requirements
The bidder must confirm that neither it nor any person with management or representation authority is subject to an exclusion ground. These include final convictions within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or related activities, money laundering or terrorist financing, and the use of child labour or human trafficking.
Other possible grounds include failure to pay taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy or other insolvency, liquidation or suspended business activity; serious professional misconduct; agreements distorting competition; an unresolved conflict of interest or involvement in preparing the procurement; material or repeated breach of a previous public contract; and misrepresentation, failure to provide information or required documents, or improper attempts to obtain confidential information.
A bidder may also be excluded for enabling the employment of a foreign national unlawfully present in Estonia, violating international or Estonian sanctions, having a conviction for a tax offence, or being subject to a participation restriction set out in the tender documents. The stated threshold for unpaid taxes and social security contributions is EUR 0; the notice explains that an Estonian tax-debt certificate is not issued for debt below EUR 100 or where payment has been rescheduled. Where applicable, the bidder may describe measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The qualification and compliance requirements include:
- According to the tender-pass explanation, the bidder’s arithmetic average annual net turnover for the last three financial years completed before commencement of the procurement must be at least EUR 200,000. The notice separately states a minimum threshold of EUR 150,000; the applicable amount should be verified in the tender documents. The bidder must report the net turnover for those three financial years in the tender pass.
- During the 60 months preceding publication of the contract notice, the bidder must have properly completed, as main contractor, at least one comparable construction contract for a building with a gross internal floor area exceeding 300 m². Eligible projects include the construction, extension or reconstruction of residential, accommodation and catering, office, entertainment, educational, healthcare or other public buildings. The tender pass must include a list of contracts stating the client’s name and contact details, work description, building area, contract period and, where the contract resulted from a public procurement, its reference number.
- The bidder must have a quality management system in the construction field meeting at least ISO 9001 requirements and an environmental management system meeting at least ISO 14001 requirements. Valid certificates or equivalent evidence must be provided; documents demonstrating equivalent measures may be accepted where justified.
The tender must comply with the procurement documents; conditional tenders are not permitted. The tender price must follow the prescribed structure. A joint tender must include a power of attorney for the joint bidders. Bidders must inspect the site in person before submitting a tender; a tenderer that has not done so will have its tender declared non-compliant.
For furniture, the bidder must confirm that the timber comes from legal sources and provide proof of origin on delivery. Substances on the REACH Candidate List present above 0.1% by weight must be declared, with evidence on delivery confirming their presence or absence. Furniture must be dismantlable and repairable using hand tools, and dismantling and repair instructions must be supplied. The furniture warranty must last at least two years, and spare parts or functionally equivalent components must remain available for at least two years after delivery. Any claimed equivalence must be explained and supported by evidence.
