Compliance requirements

The European Single Procurement Document requires declarations concerning exclusion grounds. These include final convictions within the previous five years, or an exclusion period still in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; insolvency, bankruptcy, liquidation, creditor arrangements or suspended business; serious professional misconduct; competition-distorting agreements; unresolvable conflicts of interest or an unfair advantage from involvement in preparing the procurement; serious failures under previous contracts; false or misleading information, withholding information, failure to provide requested documents, or seeking confidential information improperly; and breaches of environmental, social or labour obligations. National grounds also cover enabling the unlawful employment of a foreign national, being subject to an applicable international sanction, relevant tax offences, and restrictions on the right to participate based on the bidder’s place of establishment. The tax-debt threshold is stated as EUR 0, with explanatory text noting that the Estonian tax authority does not issue a tax-debt certificate where the debt is below EUR 100 or payment has been deferred. Where permitted, a bidder may provide evidence of remedial measures to restore its reliability.

Qualification criteria and exclusion grounds

The notice does not set out separate financial, experience or other selection thresholds. The tender documents require the following compliance information and commitments: - For a joint bid, submit an authorisation naming the joint bidders’ representative and a separate European Single Procurement Document for each joint bidder. - Identify any information claimed as a trade secret and explain why it qualifies; bid prices and other specified evaluation figures may not be classified as trade secrets. - Confirm acceptance of all tender-document and draft-contract terms, submit pricing in the prescribed format, and confirm that the offer meets the requirements. Explain any proposed equivalence and provide supporting evidence where necessary. - Confirm that the vehicle is not subject to international sanctions and does not originate from a sanctioned region. Provide the names and personal identification codes of the bidder’s authorised or managing persons not visible in the procurement register, or confirm that there are none. - Commit to using subcontractors and suppliers established in Estonia, another EU Member State, an EEA contracting state or a state party to the WTO Government Procurement Agreement. - Provide service-point details and the prescribed confirmation form. Maintenance, emergency repairs and warranty service must be available in Tallinn, Tartu and Pärnu, and in at least one of Rakvere, Jõhvi, Kohtla-Järve or Narva. - Demonstrate compliance of the vehicle and its equipment with the technical description using the prescribed vehicle requirements and bid form, with additional information or evidence where needed. - Submit a schedule describing and pricing scheduled warranty-period maintenance. Prices must cover all necessary work, replacement parts and technical fluids, remain binding and not increase during the contract. Sum the scheduled maintenance costs for operation up to 150,000 km or 60 months; this total is one component of the bid price.
