Compliance requirements
A bidder may be excluded for relevant convictions of the bidder or its representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Grounds also include failure to pay taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation or comparable situations; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest or advantage from involvement in preparing the procurement; serious or persistent failures under previous contracts; false or misleading information, withholding information, failure to provide requested documents, or improper attempts to influence the procurement or obtain confidential information. National grounds include enabling a foreign national to work unlawfully, being subject to an international sanction, and certain tax offences. The tax-debt information notes that a tax debt below EUR 100 or a deferred payment may affect issuance of a tax-debt certificate. First-tier subcontractors are also checked against the stated exclusion grounds during contract performance.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment. The contracting authority will verify this; a bidder registered abroad must provide proof of registration in its country if requested.
With the tender, the bidder must provide the names and roles of the persons responsible for the works referred to in points 6.2.1 and 6.2.2 of the technical description, together with their professional certificate numbers and a reference to the public register of professional qualifications, or equivalent evidence of qualifications. The project manager and the water supply and sewerage works project manager must meet the requirements in those technical-description points. The precise qualification requirements are set out in the technical description.
The tender must comply with the procurement documents and must not be conditional. The price must follow the structure provided in the evaluation criteria and assessed indicators worksheet. Where equivalence is relevant, the bidder must explain it and provide supporting evidence. For a joint tender, the joint bidders must appoint an authorised representative and include the power of attorney with the tender. The bidder must identify any claimed trade secrets and explain why they qualify; prices and other specified evaluation-related figures may not be designated as trade secrets. The documents provided do not specify the award-scoring details; check the official tender documents for them.
