Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded for final convictions within the past five years, or while an exclusion period remains in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and human trafficking. These grounds also apply to relevant members of the bidder’s management, supervisory or governing bodies and persons authorised to represent or control the bidder. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, suspension of business, creditor arrangements or comparable situations; serious professional misconduct; anti-competitive agreements; an unresolved conflict of interest; involvement in preparing this procurement where an advantage cannot otherwise be neutralised; serious or repeated breaches of earlier contracts resulting in early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procurement. National grounds also cover enabling a person without lawful status to work, being subject to international sanctions that would make the contract unlawful, tax-related convictions, and any restriction on the right to submit a bid established in the tender documents. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover in the most recently completed financial year must be at least EUR 130,000. Joint bidders may combine their turnover. If relying on another entity’s financial capacity, the bidder must identify that entity and provide its European Single Procurement Document; the supporting entity must accept joint and several liability for the relevant part of the contract. Within the 36 months preceding commencement of the procurement, the bidder must have completed at least one installation and/or maintenance contract worth at least EUR 100,000 excluding VAT. The contract must concern an intelligent transport system, traffic counting equipment, or technically similar fixed outdoor measuring equipment that measures at least four different parameters in real time and records and transmits them by modem to a digital database. The bidder must provide contract details and, when requested, customer confirmation of the work, its duration and value. If relying on another entity’s technical capacity, that entity must participate directly in performing the relevant part of the contract. The bidder must operate an environmental management system complying with ISO 14001 or an equivalent standard and provide a certificate or independent evidence when requested. This requirement cannot be met by relying on another entity’s certificate; for a joint bid, each joint bidder must meet it. The bidder must accept the tender conditions and submit a bid covering all requested matters. It must identify any trade secrets and justify that designation; prices and other specified evaluation figures cannot be designated as trade secrets. For checks concerning criminal convictions, provide the names and personal identification codes of authorised representatives not visible in the commercial register, or confirm that there are none. Joint bidders must submit separate procurement passports and an authorisation for their representative. The bid must include the completed price breakdown spreadsheet, with all payment items priced in euros to two decimal places, excluding VAT; the supplied spreadsheet must not be altered beyond what is required to complete it. The bidder must also submit the prescribed declaration of the EURO emissions standard for vehicles used to perform maintenance. This declaration is binding and forms part of the contract if awarded, and it is used in bid evaluation; the detailed evaluation method must be checked in the tender documents. The bidder must confirm compliance with the applicable restrictions on Russian-linked subcontractors and suppliers and that any offered goods are not subject to international sanctions or from sanctioned regions.
