Compliance requirements
A bidder will be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to the employment of foreign nationals without legal grounds or below the required pay rate; or offences involving illegal child labour or human trafficking. A bidder will also be excluded for outstanding national taxes, payments or environmental charges, or tax or social security contributions owed under the law of its country of establishment.
The contracting authority may exclude a bidder that has seriously or repeatedly breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or has failed to provide that information or requested supporting documents.
Companies established or resident in the Russian Federation or the Republic of Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the contract subject. At least one contract must have had a value of at least EUR 100,000 excluding VAT. The bidder must provide a list of the contracts, including their performance periods, details of the other contracting parties and the customer representative’s contact details (including telephone number and email address); for public procurements, reference numbers must also be stated. At the contracting authority’s request, evidence of proper performance must be provided unless the authority can obtain the information from public or private databases without significant expense.
The bidder must have an employee with valid switching authorisations for switching operations on the 0.22–20 kV electricity network related to the works, except at regional and distribution substations. That employee must be registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage works only (0.22–1 kV), low-voltage switching authorisations are sufficient. In other cases, both low- and medium-voltage authorisations are required, including where low-voltage works require switching on the 1–20 kV side.
The bidder must have a person appointed as responsible for the work operation, registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person managing electrical works with a valid A-level competence and/or a qualification of at least level 6 under the Professions Act. That person must hold the relevant evidence by the tender submission deadline and be registered in the partner portal before tenders are opened.
The tender must include a price table in the form provided in the procurement documents, with every unit-price field completed. It must comply with the procurement documents; additional conditions and conditional tenders are not permitted. The instructions for completing document V178 of the management system must also be followed when preparing the works.
The bidder must provide the name, position and contact details of the person signing the contract, as well as those of the contact person for contract-performance matters. If the signatory’s authority is not established by the articles of association, a power of attorney must be included. The bidder must identify and justify any information in its tender claimed as a trade secret; the tender price and other evaluation-related figures specified by law may not be designated as trade secrets.
The contracting authority’s standard payment periods from receipt of an invoice are 14 calendar days for contract values up to EUR 59,999, 35 calendar days for values from EUR 60,000 to EUR 249,999, and 45 calendar days for values of EUR 250,000 or more. If the bidder joins the authority’s factoring programme, the payment period is 95 calendar days.
