Compliance requirements
The buyer must exclude a bidder if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences, money laundering or terrorist financing; offences relating to enabling unlawful employment of foreign nationals or breaches of their employment conditions in Estonia; or illegal use of child labour or human trafficking. A bidder must also be excluded for outstanding state taxes, charges or environmental fees, or tax or social security contributions owed under the law of its country of establishment.
The buyer may exclude a bidder for materially or repeatedly breaching an important term of a previous public contract where this led to termination, withdrawal, a price reduction, compensation or a contractual penalty. The buyer may also exclude a bidder for providing false information about compliance with qualification requirements or failing to provide such information or requested additional documents.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this contract. At least one contract must have had a value of EUR 40,000 or more, excluding VAT. The bidder must provide a list showing the performance period, details of the other contracting parties and the customer's representative's contact details, including a telephone number and email address; public procurement contract reference numbers must also be given. The buyer may request evidence of proper performance.
For switching operations related to the works, the bidder must have an employee with valid switching authorisations who is registered in Elektrilevi's Partner Portal. For low-voltage works only (0.22–1 kV), low-voltage switching authorisations are sufficient; in other cases, both low- and medium-voltage switching authorisations are required, including where low-voltage works require switching on the medium-voltage side. The bidder must also have a person responsible for the work operation, registered in the same portal.
The team must include an electrical works manager with valid A-level competence and/or a professional qualification at level 6 or higher, together with evidence of that qualification. This person must be registered in Elektrilevi's Partner Portal before the deadline for submission of tenders.
The tender must comply with the procurement documents; conditional tenders and tenders containing additional conditions are not permitted. The bidder must submit the price table using the form in the procurement documents and complete every unit-price field, taking into account the instructions for completing management-system document V178. The bidder must provide the name, position and contact details of the contract signatory and the contact person for contract performance; a power of attorney must be included if the signatory's authority does not arise from the articles of association. The bidder must identify and justify any information treated as a trade secret; the tender price and figures relevant to evaluation may not be designated as trade secrets.
The bidder must not be established or resident in the Russian Federation or the Republic of Belarus. Materials, equipment, goods and components used in the works must not be produced in or originate from Russia or Belarus; the buyer may request certificates of origin.
The invoice payment period is 14 calendar days for a contract value up to EUR 59,999; 35 calendar days for EUR 60,000–249,999; and 45 calendar days for EUR 250,000 or more, starting when the buyer receives the invoice. Participation in the buyer's factoring programme results in a 95-calendar-day payment period. The selected documents do not specify the award criteria; these should be checked in the procurement documents.
