Compliance requirements

The bidder must confirm that neither it nor its administrative, management or supervisory body members, procurators or other persons with powers of representation or control have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, illegal child labour or human trafficking. Where applicable, details of the conviction and measures taken to restore reliability must be provided. The bidder must not have outstanding tax or social security contribution debts. For both categories, the notice states a threshold of EUR 0; however, when issuing a tax debt certificate, tax debts below EUR 100 or debts subject to a payment schedule may not be shown on the certificate. Additional exclusion grounds may include bankruptcy, insolvency or liquidation proceedings, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, agreements distorting competition, an unavoidable conflict of interest, involvement in preparing the procurement, a serious breach or early termination of a previous public contract, submission of false information or failure to provide required documents, and improper influence over the contracting authority's decision-making process. Compliance with environmental, social and labour-law obligations is also checked, as are the employment of illegally staying foreign nationals, the application of international sanctions and convictions for tax offences. For all exclusion grounds, the bidder must provide the required self-declarations in the European Single Procurement Document and, where applicable, details of electronically available evidence or supporting documents.

Qualification criteria and exclusion grounds

The bidder must be the official representative of the products offered or submit written consent from the manufacturer's representative. Evidence of the right of representation must be provided. The bidder must submit the participation application (Form 1), the completed price tender (Form 4) and, where applicable, a power of attorney for the signatory (Form 2). In the case of a joint tender, a power of attorney for the joint tenderers must be included. The products offered must comply with the technical specification (Annex 1 to the tender documents). For each product, the bidder must submit descriptions, manufacturer information, instructions for use, certificates, declarations of conformity or other evidence enabling the contracting authority to verify compliance. Products in Lots 1–4 must be listed in the Agriculture and Food Board database of food supplements and foods for special medical purposes. Lot 2 concerns nutritionally complete food for drinking with an energy content of 2.0 kcal/1 ml, Lot 3 concerns the corresponding product with an energy content of 1.5 kcal/1 ml, and Lot 4 concerns the corresponding product with an energy content of 2.4 kcal/1 ml. Lot 5 covers parenteral nutrition solutions under ATC code B05BA10; their combinations must be registered with the Estonian State Agency of Medicines and the registration must be evidenced. Lot 6 covers additives for intravenous solutions under ATC code B05XC80; these must be registered with the Estonian State Agency of Medicines, or their procurement must be possible under an application for the use of an unlicensed medicinal product, which must also be evidenced. The tender must be unconditional and comply with all tender documents. If an equivalent product is offered, its equivalence must be explained and the necessary evidence submitted. The machine-readable notice does not state separate turnover, previous experience or team qualification requirements.
