Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory board members or authorised representatives have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful use of child labour or human trafficking offences. The bidder must also have no tax or social security debt, environmental, social or labour-law violations, bankruptcy, liquidation or other insolvency proceedings, arrangement with creditors, suspended business activity, serious professional misconduct, anti-competitive agreement, unresolved conflict of interest or improper involvement in preparing the procurement. Grounds may also arise from serious or repeated breaches of previous public contracts, false statements, failure to provide required information or documents, improper influence on the contracting authority or obtaining confidential information. The bidder must additionally have no violations related to employing unlawfully present foreign nationals, no risk of breaching international or Estonian sanctions, and no conviction for a tax offence. The bidder must provide the required declarations and, where applicable, evidence; where an exclusion ground exists, evidence of remedial measures may be submitted in cases permitted by law or the tender documents.
Qualification criteria and exclusion grounds
The bidder must provide the required declarations and meet the following requirements:
- The project manager must have at least 2 years of experience, during the 5 years preceding publication of the contract notice, as a project manager of software, web or mobile application development projects. The bidder must submit the project manager’s digitally signed CV using Annex 4 Form III, including project details, role, duties, duration to the nearest month and year, client contact details and a short description.
- The lead developer must have at least 3 years of software, web or mobile application development experience during the same 5-year period and must have participated in at least two digital solution development projects. A digitally signed CV using Annex 4 Form IV must be submitted.
- The UX/UI designer must have at least 2 years of UX/UI design experience during the same 5-year period and must have participated in designing at least two digital solutions. A digitally signed CV using Annex 4 Form V must be submitted.
- One person may perform no more than two required roles. If roles are combined, that person must meet the experience requirements for both roles, and the bidder must explain how all duties will be performed properly and on time. Separate CVs must be submitted for each role where required.
- The team must have the competence required for technical architecture, web and mobile solutions, integrations, information security, performance, scalability, UX, UI, accessibility, testing and administration solutions. Additional specialists may be engaged for quality assurance, information security, DevOps, analytics or accessibility, for example.
- The tender must include a technical solution description of up to 5 A4 pages covering, among other matters, architecture, mobile and web solutions, authentication, data processing, administration interface, analytics, maintainability, security, reliability, performance, scalability, accessibility and data protection.
- The bidder must submit a UX/UI solution concept of up to 3 A4 pages containing an initial visual concept and explanation for the programme home page, one main user view and one content module or quick-help function.
- The bidder must submit a development process work plan describing the work stages and their order, the initial timetable and deliverables, cooperation with the contracting authority, testing, handover and publication, and technical, scheduling and organisational risks with mitigation measures.
- The tender must comply with the procurement documents; equivalence must be explained and evidenced where necessary. Conditional tenders are not permitted. The tender must be signed by a person with authority to represent the bidder; if signed by another person, a power of attorney using Annex 4 Form I must be submitted. For a joint tender, a power of attorney and a joint and several liability statement using Annex 4 Form II must be submitted.
- Communication and documents during contract performance must be in Estonian. If a team member does not speak Estonian, the bidder must provide a competent interpreter at its own expense.
- The bidder must comply with environmental requirements and avoid negative environmental impacts from providing the service. Team members may generally be replaced during contract performance only with the contracting authority’s agreement and at least 30 days’ prior notice; a replacement must have equivalent or greater experience and continuity of performance must be ensured.
