Compliance requirements
The bidder, or any member of its management, administrative or supervisory body, procurator, or other person with authority to represent or control the bidder, must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, terrorist financing, enabling the employment of an unlawfully residing foreign national, breaches of conditions for employing a foreign national, illegal use of child labour, or trafficking in human beings. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax and social security contribution debts. The contracting authority may also exclude a bidder for a material or repeated breach of a previous public contract, termination of a contract, price reduction, compensation or a contractual penalty, or for submitting false information or failing to provide required documents. The bidder must confirm that none of these mandatory or discretionary exclusion grounds apply. Participation is prohibited for an undertaking established or resident in the Russian Federation or the Republic of Belarus. Materials, equipment, goods or components produced in or originating from Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this tender. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the contracting party representative’s contact details and, for public contracts, the procurement reference numbers. Evidence of proper performance must be provided upon request.
For switching operations in the 0.22–20 kV electricity network related to the works, the bidder must have an employee with valid switching rights who has been registered in Elektrilevi’s partner portal before the bids are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The bidder must also have a person responsible for the work operation, registered in the same portal before the bids are opened.
The bidder must have a person managing electrical works who holds a valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act. The person must hold the relevant certificate when the bid is submitted and must be registered in the portal before the bids are opened. The bid must comply with all tender document requirements; bids containing additional conditions or conditions may not be submitted. The bidder must provide a fully completed price table with all unit-price fields, confirmation of the contract signatory’s authority to represent the bidder and, where necessary, a power of attorney, as well as the contact person’s details for contract performance. The bid must identify and justify any trade secrets or state that it contains none. The bid price and component prices may not be classified as trade secrets.
