Compliance requirements
A bidder will be excluded if the bidder or its management, supervisory or representative persons have been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism, money laundering, terrorist financing, enabling illegal employment or breaches relating to the employment of foreign nationals, illegal use of child labour, or human trafficking. The bidder must also have no state tax, duty or environmental charge arrears and no tax or social security contribution arrears. The bidder must confirm that none of the mandatory exclusion grounds apply.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached material terms of a previous public contract, or submitted false information concerning compliance with selection criteria or failed to submit required information or documents. The bidder must confirm that none of these voluntary exclusion grounds apply. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components produced in or originating from Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin as evidence.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties, the client representative’s contact details and, for public contracts, the reference numbers. Upon request, evidence of proper performance must be provided.
The bidder must have an employee with valid switching authorisations for switching operations in a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. For works limited to 0.22–1 kV, at least low-voltage switching authorisation is required; in other cases, both low- and medium-voltage switching authorisations are required. The bidder must also have a person responsible for the work operation, registered in the same portal before the tenders are opened.
The bidder must have a person managing electrical works who holds valid A-level competence or a qualification of at least level 6 under the Estonian Vocational Qualifications Act, possesses the relevant certificate when submitting the tender, and is registered in the partner portal before the tenders are opened. The tender must include confirmation of the signatory’s authority to represent the bidder, the signatory’s details, the contract performance contact person’s details and, where necessary, a power of attorney. The tender price must be submitted using the required form and all unit-price fields must be completed; conditional tenders or tenders containing additional conditions are not permitted. The bidder must identify and justify any trade secrets or confirm that the tender contains no trade secrets.
