A bidder will be excluded if the company, a member of its administrative, management or supervisory body, a procurator or an authorised representative has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or another serious offence specified in the tender documents. Exclusion also applies to convictions for enabling an unlawfully residing foreign national to work in Estonia, allowing work on terms involving pay below the statutory rate, unlawful use of child labour or human trafficking. The bidder must not have outstanding state tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract, submission of false information, or failure to submit required information or documents. Companies established or residing in the Russian Federation or the Republic of Belarus may not participate. The bidder must confirm that these exclusion grounds do not apply.

During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this tender. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, information about the other contracting parties, the client’s contact details and, for public contracts, the procurement reference numbers. The contracting authority may also request evidence of proper performance. The team must include an employee authorised to perform switching operations related to the works in a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only, at least MP switching authorisation is required; in other cases both MP and KP switching authorisations are required. The team must also include a person responsible for work operations, registered in the same portal before the tender deadline, and a person leading the electrical works who holds valid A competence or a qualification of at least level 6 under the Occupational Qualifications Act, together with the relevant evidence and portal registration. The tender must include a fully completed price table in the contracting authority’s format, including all unit-price fields. Conditional tenders or tenders containing additional conditions are not permitted. The bidder must provide the details of the contract signatory and the contact person for contract performance and, where necessary, a power of attorney. In a joint tender, a power of attorney for the joint bidders must be submitted. Materials, equipment and goods used in the works, including components, may not be produced in or originate from the Russian Federation or Belarus; the contracting authority may request certificates of origin. The bidder must identify and justify any trade secrets, but may not classify the tender price or other prohibited numerical indicators as trade secrets.
