Compliance requirements

The bidder and its administrative, management or supervisory body members, representatives and persons with control or signing authority must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the unlawful use of child labour or other forms of human trafficking, unless the exclusion period no longer applies. Where relevant, the bidder must describe the measures taken to restore its reliability and provide supporting information. The bidder must not have outstanding tax or social security payment obligations. The notice states a threshold of EUR 0 for tax and social security payment arrears; however, a tax debt certificate is not issued where the debt for all taxes administered by the same tax authority is below EUR 100 or payment of the debt has been deferred. Additional exclusion grounds may include allowing an unlawfully staying foreign national to work or violating the conditions for a foreign national’s employment in Estonia, including paying less than the required wage, as well as concluding the contract with a subject of an international or Estonian sanction. The bidder must provide the declarations required in the European Single Procurement Document and, where necessary, electronically available evidence.

Qualification criteria and exclusion grounds

During the 36 months preceding the start of the procurement, the bidder must have completed and handed over to the client at least two main designs for the construction or reconstruction of a road or street. Each reference project must have had a value of at least EUR 10,000 excluding VAT. The bidder must provide information on the works, value, period, client and its area of responsibility, together with contact details and supporting evidence where required. The specialist responsible for the design must hold at least a Level 7 diploma road engineer qualification, specialising in roads with the design work component. The bidder must provide the specialist’s name, position, qualification and experience, together with qualification evidence. The tender must comply with all conditions set out in the procurement documents, and conditional tenders are not permitted. The tender price must be submitted according to the structure specified under the award criteria and rated indicators. In the case of a joint tender, a power of attorney from the joint tenderers must be included.
