Compliance requirements
The tenderer may be excluded for final convictions within the applicable period, including convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include breaches of tax or social-security payment obligations; breaches of environmental, social or labour-law obligations; bankruptcy, liquidation, insolvency or comparable situations; suspension of business; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; and serious or repeated failure to perform a previous contract resulting in termination, damages or penalties. Exclusion may also follow from false or misleading information, failure to provide required information or documents, improper attempts to influence the contracting authority or obtain confidential information, specified tax offences, and enabling a person without legal grounds to work or violating the conditions for foreign nationals’ work. International sanctions grounds apply, including restrictions concerning sanctioned goods or regions and the applicable restrictions on Russian or Belarusian entities. Tax-debt rules include the stated national threshold and exceptions where the debt is below EUR 100 or payment has been deferred. Where legally permitted, the tenderer may provide evidence of remedial measures demonstrating restored reliability.
Qualification criteria and exclusion grounds
The following requirements apply to the relevant lots:
- The tenderer must hold the required authorisation or registration to provide catering services. An Estonian tenderer must have submitted a notice of economic activity for catering in the Register of Economic Activities. A foreign tenderer must hold the equivalent registration or permit under its country’s law and provide evidence issued by the competent authority.
- For lots 1 and 3–8, the tenderer must have completed at least one catering services contract worth at least EUR 30,000 excluding VAT during the 36 months before the procurement began (September 2023 until the contract notice deadline). A contract still in progress counts only if at least EUR 30,000 of services had been completed during that period. The tenderer must provide a list showing contract values, dates, contracting parties and contact details; for public contracts, include the reference numbers.
- For lot 2, the tenderer must have properly completed at least one catering services contract for a social care, healthcare or educational institution during the 36 months before the procurement began. No minimum contract value is specified.
- For lot 2, at least one responsible cook must hold a valid Cook, Level 4 professional certificate or an equivalent qualification. The tenderer must identify the cook and provide evidence of the qualification or information allowing its validity to be checked. A qualified responsible cook must remain in charge throughout the contract.
- For all lots, the tenderer must operate an effective HACCP-based or equivalent food-safety self-monitoring system covering food preparation, storage, packaging and transport. The contracting authority may request the self-monitoring plan and evidence of its implementation.
The bid must be unconditional and confirm acceptance of the tender documents. It must include a two-week sample menu, showing food weights in grams per person by day and meal. For lot 1, submit the menu for that lot; for lot 2, the lot 2 menu; and for lots 3–8, the menus for the relevant lots. For lot 2, the tenderer must visit the contract performance site at Nõmmekodu, Pihlaka 12, Tallinn, on 9 November 2026 from 14:00 to 15:00; failure to attend precludes submission for that lot.
Submit the price in the prescribed format as the price per person per meal-day, both excluding and including VAT, to two decimal places. It must include all service costs, remain fixed for the contract period, and must not be zero or negative. Where an equivalent service or solution is offered, provide evidence of equivalence and a comparison table showing how it meets the technical requirements. Identify and justify any confidential business information; prices and other numerical figures used for evaluation may not be classified as confidential. Joint tenderers must appoint an authorised representative and are jointly and severally liable. The contracting authority also considers offered added value in the evaluation; providing it is optional, and no points are awarded for this criterion if none is offered. The exact scoring details are not stated here.
