The bidder must confirm that neither it nor its representatives or management and supervisory body members is subject to any applicable exclusion ground. The checks cover, among other matters, final criminal convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, and the use of child labour or other forms of human trafficking. They also cover payment of taxes and social security contributions, bankruptcy, liquidation and other insolvency situations, breaches of environmental, social or labour law, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement procedure, material breaches of previous contracts, and the submission of false information or failure to provide required information and documents. Statutory exclusion grounds concerning unlawful employment of foreign nationals in Estonia, international sanctions, tax offences and restrictions on participation in public procurement also apply. Where an exclusion ground exists, the bidder may submit evidence of permitted remedial measures demonstrating restored reliability. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers covered by the Russian sanctions restrictions.

The bidder’s total net turnover must have been at least €900,000 in each of the three most recent completed financial years preceding publication of the contract notice. The requirement applies separately to each relevant financial year. During the 36 months preceding the start of the procurement, the bidder must have completed at least one development contract in the field of language technology services with a value of at least €200,000 excluding VAT. An eligible contract or project must have involved developing, adapting or implementing a language-technology IT solution, such as a machine translation system or another language-technology-based service. The bidder must provide the contract details, value, description of the work, its area of responsibility, performance period, and the contracting authority’s and contact person’s details. The procurement reference number must be added where applicable. A contract is considered completed to the required extent when the work has been delivered to and accepted by the client. The framework agreement itself cannot be submitted as a reference, but an eligible contract concluded under a framework agreement may be used. The bidder must provide at least the following contract performance team: one project manager, one translation-sector expert and two software developers. Each member’s signed CV, evidence of the required experience and, for the project manager and software developers, copies or extracts of education certificates or other educational evidence must be submitted. No education document is required for the translation-sector expert. The prescribed CV forms must be used for the project manager, translation-sector expert and both software developers, and the necessary evidence, including a client confirmation letter for project work where required, must be included. The bidder must also confirm that it will provide a sufficiently large additional team. The tender must include solutions for three practical tasks. For each task, the bidder must submit the code-change file and a screen-recording video presenting the solution, or a document containing a download link to the video. A written explanation of the solution is also required for Task 2. The videos must clearly demonstrate all required tasks and elements; WMV, AVI and MP4 or equivalent formats are accepted. If an external link is used, the video must be time-stamped before the submission deadline, remain unchanged and be downloadable by the contracting authority without restrictions. The tender must comply with the procurement documents and may not be conditional; the price must be submitted in the prescribed structure. A joint tender requires a power of attorney for the joint tenderers. Only subcontractors and suppliers established in permitted countries may be used during contract performance. Compliance with the environmental requirements must be confirmed, and any trade secrets must be identified in the tender; the tender price and numerical figures used in the evaluation may not be classified as trade secrets.
