Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The tenderer may be excluded if it, or a person authorised to represent, manage, control or make decisions for it, has a final conviction within the previous five years—or remains subject to an exclusion period—for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking. Where permitted for this procurement, the tenderer may provide evidence of measures taken to restore its reliability. Exclusion also applies for breaches of tax or social security payment obligations in Estonia or the tenderer’s country of establishment. Tax arrears below EUR 100, excluding interest not established by an administrative act, or arrears whose payment has been rescheduled, are treated as described in the notice; foreign tenderers are assessed under the rules of their country of establishment. A tenderer may also be excluded for enabling unlawful employment of a foreign national, where entering into the contract would breach an international or Estonian government sanction, or where it breaches a restriction on eligibility to participate. The tenderer must provide the requested confirmations; further evidence may be required where there is justified doubt.

Qualification criteria and exclusion grounds

The tenderer must submit, using the prescribed form, its motivation and vision for creating the learning pack in line with the concept and prototype for each relevant lot, together with an itemised development cost breakdown and an initial schedule. Prices must follow the structure in the pricing and evaluation worksheet, and the development cost breakdown must also be included in the submission form. Conditional tenders are not permitted; submission confirms acceptance of the tender-document conditions. The tenderer must provide team-member details and a signed CV for each member, together with copies of documents proving education or a link to a free public database where higher education can be verified. The specific team qualifications are set out in the technical description and must be checked there. The tenderer must also provide the names and personal identification codes of authorised representatives who can represent, make decisions for, or control the tenderer but are not listed in the commercial register. If submitting jointly, the tenderers must appoint an authorised representative and provide the relevant authorisation. The tenderer must confirm readiness for the whole team to attend meetings with the contracting authority if requested. During contract performance, subcontractors and suppliers may be engaged only if established or resident in Estonia, another EU Member State, an EEA contracting state, or a country party to the WTO Government Procurement Agreement. The tenderer must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals or residents, entities established in Russia, entities more than 50% owned by such persons or entities, or persons or entities acting on their behalf or instructions. The offered goods must not be subject to international sanctions or originate from sanctioned regions. The tenderer must identify any trade secrets in its tender and explain why the information qualifies. Prices, price components, and other figures or indicators used in evaluating the tender may not be designated as trade secrets. The extracted document does not specify the detailed evaluation criteria or scoring; check the official tender documents for those details.
