The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives has been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking offences. If such a ground exists, the contracting authority may request conviction details and a description of measures taken to restore reliability. Non-payment of taxes or social security contributions may constitute a ground for exclusion. In Estonia, a tax debt certificate is not issued where the debt for taxes administered by the same tax authority is below EUR 100 or payment of the debt has been deferred; for foreign bidders, the rules of the bidder’s country of establishment apply. The bidder must also confirm compliance with tax and social security obligations or the existence of a binding payment arrangement. Exclusion grounds also include bankruptcy, liquidation or another insolvency procedure, assets being administered by a liquidator or court, suspended business activity, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement, material breach or early termination of a previous procurement contract, and the submission of false information or failure to provide required documents. The bidder must also confirm compliance with environmental, social and labour-law obligations. Under Estonian law, the bidder must confirm that it has no connection with enabling illegally staying foreign nationals to work, breaches of international or Estonian sanctions, or convictions for tax offences. The bidder must submit the required declarations and, where applicable, evidence in accordance with the ESPD and the tender documents.

The bidder must have previous experience in the manufacture and/or sale of various search and rescue equipment. During the 36 months preceding the start of the procurement, the bidder must have properly completed at least one contract or order for products related to the subject matter of the tender for at least one European Union Member State or candidate country, with a total value of at least EUR 20,000 excluding VAT. The bidder must provide a description of the contract or order, its value, performance period, client and contact details, and the bidder’s scope of responsibility. The bidder must properly complete and submit the compliance matrix and tender submission form. For each offered product, the bidder must indicate whether the product is offered, its unit price and delivery time in calendar days. The bidder may offer any number of product categories. By submitting a tender, the bidder must confirm acceptance of all tender document conditions; conditional tenders are not permitted. The tender must comply with the requirements in the tender documents. Where an equivalent product or solution is offered, the bidder must explain the equivalence and provide supporting evidence. The bidder must also provide the signatory’s details, the basis of authority to represent the bidder and the bank details required for contract conclusion. In a joint tender, a power of attorney for the joint tenderers must be submitted. The bidder and the offered goods must comply with the registration and origin restrictions arising from the European Peace Facility support agreement. The bidder must confirm that the goods are not subject to international sanctions and do not originate from a sanctioned region, and that it will not use Russian-linked subcontractors or suppliers for more than 10% of the contract value. Trade secrets must be identified and justified separately; the tender price and impermissible price-related evaluation figures may not be classified as trade secrets.
