Compliance requirements
The contracting authority will exclude a bidder if any exclusion ground under Section 95(1) of the Estonian Public Procurement Act applies. The bidder must confirm that neither it nor its representatives have been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering, terrorist financing, unlawful use of child labour, or human trafficking. The bidder must also confirm that it has no tax debt or social security contribution debt and that the contract award does not breach international sanctions or sanctions imposed by the Government of the Republic. If the tender is submitted together with a foreign undertaking, documents confirming the absence of exclusion grounds must also be provided for that undertaking and its management or representative persons. If the contracting authority cannot verify the information from public registers, it may request additional documents.
Qualification criteria and exclusion grounds
The bidder must have total net turnover of at least EUR 3,000,000 excluding VAT for the last three financial years ended by the start date of the procurement, with at least EUR 1,000,000 in each year. If the bidder is not a legal entity registered in Estonia, or if the contracting authority cannot verify the information from public sources, the bidder must provide annual report extracts and/or other documents proving compliance. Joint bidders may rely on each other’s figures.
The bidder must also prove technical and professional capability by showing that, within the 60 months before the procurement procedure started, it has properly performed at least one contract for the installation of a 110 kV or higher-voltage cable line, including design, cable and cable joint installation, and commissioning of the cable line. The referenced contract must have a value of at least EUR 1,000,000 excluding VAT. The contract may have started earlier than the 60-month period, but the relevant works and design must have been performed properly within the period set by the contracting authority.
The bidder must submit the required completed forms, questionnaires, certificates, reference lists, independent laboratory test reports, cable current calculation, technical description of the planned works, team CV form, cable joint installer certificate, financing schedule, and any equivalent supporting documents required in the tender documents. If equivalence is relied on, supporting evidence must be provided. If the bidder is a foreign undertaking or relies on another entity, the relevant supporting documents and confirmations must be submitted as required in the tender documents.
