Compliance requirements
Exclusion grounds cover final convictions within the previous five years, or an exclusion period that remains in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. The grounds apply to the bidder and relevant members of its administrative, management or supervisory bodies, or persons authorised to represent, make decisions for or control it. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
The bidder may also be excluded for unpaid taxes or social security contributions in its country of establishment or the contracting authority’s country. The stated threshold is EUR 0; the notice explains that, under Estonian rules, tax arrears below EUR 100 (excluding interest not established by an administrative act) do not result in a tax-debt certificate, and scheduled debts are treated separately. Exclusion also applies where awarding the contract would violate an international or Estonian government sanction. The bidder must declare whether any of these grounds apply; where relevant, it may provide information about payment, binding payment arrangements or corrective measures.
