Compliance requirements
The bidder must confirm that neither it nor its representatives subject to the relevant rules have a final conviction within the preceding five years, or a continuing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Where permitted for this procurement, the bidder may describe measures taken to restore its reliability.
Exclusion grounds also include unpaid taxes or social security contributions. The stated threshold is EUR 0; the notice explains that, under Estonian rules, a tax-debt certificate is not issued where the debt is below EUR 100 (excluding interest not determined by an administrative act) or payment has been rescheduled. The bidder must also not have enabled a foreign national without a lawful basis to work, or violated the applicable conditions for employing a foreign national. The bidder must confirm that it is not subject to international sanctions and that the bidder, its subcontractors and any relied-upon entities are not established or located in Russia or Belarus. The bidder also confirms that it will not use a subcontractor subject to a ground requiring replacement under the applicable rules.
