Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded if it or a person in its management, governing or supervisory body, or a person authorised to represent, make decisions for or control it, has a relevant conviction within the previous five years or remains subject to an exclusion period. The grounds listed include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. Exclusion may also apply if the bidder has failed to meet its tax or social security contribution payment obligations, or if awarding the contract would breach an international or Estonian government sanction. The tax and social security payment threshold is EUR 0; the notice explains that tax arrears below EUR 100, excluding interest not established by an administrative act, or arrears subject to a payment schedule, are treated according to the applicable tax rules.

Qualification criteria and exclusion grounds

The bidder must be entered in a business register in its country of establishment. The bidder must have properly completed, as the main contractor, at least two contracts during the 36 months preceding the start of the procurement for the design or reconstruction design of a non-residential building. Each contract must have had a value of at least EUR 20,000 excluding VAT. The bidder must provide information on the contracts, including their value, dates and clients. The team must include a road-design specialist with a diploma-level road engineering qualification at level 7 or equivalent and competence in preparing designs, and a specialist for the design of special parts with a diploma-level engineering qualification at level 7 or equivalent and competence in preparing designs. For a joint bid, the bidders must appoint an authorised representative from among themselves and provide the authorisation. The bidder must identify any trade secrets in the bid and explain why they qualify as such; the bid price and other specified evaluation-related figures may not be designated as trade secrets. By submitting a bid, the bidder confirms acceptance of the tender-document requirements. Conditional bids are not permitted. The bid price must follow the structure specified in the pricing and evaluation section. Where equivalence is relevant, the bidder must explain it and provide supporting evidence.
