Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The contracting authority will exclude a bidder where any of the grounds in § 95(1), points 1–5, of the Estonian Public Procurement Act applies. The bidder must confirm that these grounds do not apply. A foreign bidder must provide a criminal-record notice or equivalent document from a court or administrative authority in its country for the circumstances in § 95(1), points 1–3, and a certificate from the competent authority in its country for the circumstances in point 4. The notice also asks whether the bidder is subject to a restriction on participation based on its place of establishment or residence under § 95(4), point 12; the applicable restriction is set out in the tender documents.

Qualification criteria and exclusion grounds

The bidder’s total net turnover from all business activities must have been at least EUR 180,000 in each of the last three financial years completed by the start of the procurement (2023, 2024 and 2025). On request, the bidder must provide extracts from its financial statements; foreign bidders must provide equivalent evidence from the competent authority in their country, or other documentation showing turnover where the latest accounts are not yet publicly available. The bidder must be registered as an insurance broker in the Estonian Financial Supervision Authority’s register of insurance intermediaries, or be registered under equivalent rules in its country. Foreign bidders must provide supporting evidence. The offer must identify a lead broker or client manager and a different deputy broker, as well as a claims manager and an aviation insurance specialist. For each key person, provide their name and role, a brief description of relevant experience and availability, and the procedure for replacing key personnel. CVs are not required. Replacements must be agreed with the contracting authority in advance and must have qualifications no lower than those of the person being replaced. One person may perform several roles if their competence and availability allow it, except that the lead broker/client manager and deputy must be different people. The broker must also ensure access, when needed, to specialists in property and business interruption, cyber, D&O, construction, environmental and other specialist risks. The broker remains responsible and the contracting authority’s point of contact even when international partners or specialists are involved. The bidder must name an international partner that provides access to the insurance market and submit written confirmation or other evidence of the cooperation and ability to place aviation risks through that partner. The offer must explain the Estonian broker’s and international partner’s roles, responsibilities, fees, communication arrangements, availability and claims-handling duties. It must include the partner’s written commitment to participate in contract performance, describe its role in marketing, negotiating and placing aviation liability insurance, policy administration and claims handling, name its key personnel, and confirm that it has the necessary resources and 24/7 aviation incident support. The bidder must provide evidence of the partner’s authorisation to act as an insurance intermediary, including a register extract, registration number and regulated activities. Where applicable, this must include evidence of cross-border authorisation for an EU/EEA partner or an FCA register extract with relevant permissions for a UK partner. Evidence of access to the international aviation insurance market is also required, such as evidence of Lloyd’s registered broker status, a current Lloyd’s Europe TOBA or relevant insurer/Lloyd’s managing agent TOBAs; if access is through another broker, provide that broker’s written confirmation of the specific cooperation and placement channel. The bidder or named aviation insurance partner must confirm its ability to place airport liability insurance on the international market, identify the markets it can access, state whether it can arrange open-market or subscription-market placements, name the insurers, Lloyd’s syndicates or managing agents with which it normally works, and clarify whether access covers airport operator liability and, where needed, war and terrorism risks. Provide at least two comparable aviation liability placements completed under contracts entered into during the five years before the submission deadline. For each reference, give the client or risk type, the partner’s role, insurance period, approximate liability limit and international market used, together with a contact or other verifiable evidence, subject to confidentiality restrictions. The experience may be that of the bidder, a named key person or the aviation insurance partner, provided each person’s role in the placement is clearly described. Provide a short experience profile for the key person responsible for aviation liability insurance, covering relevant work experience, their role in comparable placements, relevant qualifications and training, and experience with major claims and international aviation requirements. Describe the division of work and responsibility between the Estonian broker and international partner, including who prepares the risk presentation, approaches and negotiates with the market, checks insurers’ participation and financial strength, handles policy documents and claims, and provides escalation and 24/7 support. If the named partner will provide insurance intermediary services under the contract, provide evidence of its valid professional indemnity insurance or equivalent security covering those services. Submit one anonymised sample of documentation from a previous aviation liability placement or renewal. Both the broker and the named aviation liability partner must maintain professional indemnity insurance of at least EUR 5,000,000 for each claim and each insurance period throughout the contract. Provide evidence with the offer; the broker must provide updated evidence at least annually and promptly whenever cover changes. The offer must comply with the tender documents, must not be conditional, and its pricing must follow the structure specified in the pricing schedule. If claiming equivalence, explain it and provide evidence. Identify and justify any information claimed as a trade secret; prices and other evaluation-related numerical figures may not be designated as trade secrets. No specific award criterion is stated in the supplied documents.
