Compliance requirements
The bidder must confirm that no mandatory exclusion ground applies. The contracting authority will exclude a bidder where the bidder, or a person authorised to represent, manage, control or make decisions for it, has been convicted of participation in a criminal organisation, corruption or breach of integrity, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of a foreign national or breaches concerning the conditions of a foreign national’s employment in Estonia, including payment below the statutory rate, or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding national tax, social security contribution or environmental charge debts, or where the bidder or a relevant management or supervisory body member is subject to an international sanction, unless entering into the contract would not breach that sanction.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation, suspended business or a comparable situation; serious professional misconduct; agreements or coordinated conduct that distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that gives an unfair advantage which cannot otherwise be remedied; significant or repeated failure to perform an earlier public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty; false or withheld information or documents concerning qualification; attempts to improperly influence the contracting authority or obtain confidential information, or negligently providing misleading information that could affect procurement decisions; tax-related criminal offences by the bidder or a relevant representative; or lack of the legal right to submit a bid or application.
Companies domiciled or established in the Russian Federation or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must meet all of the following requirements, which apply to all lots:
- **Financial capacity:** In each of the bidder’s three most recently completed financial years, net turnover must have been at least EUR 100,000. The bidder must provide extracts from the annual accounts for those years showing net turnover. A bidder registered in Estonia need not provide information that the contracting authority can access publicly from a register. If the bidder’s financial year does not coincide with the calendar year, the requirement applies to its three most recently completed financial years. At the bid submission date, at least six months must have passed since the end of the most recently completed financial year.
- **Similar contracts:** During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the contract scope. At least one must have had a value of EUR 80,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party’s details, including a contact person’s telephone number and email address, and the procurement reference number where applicable. The contracting authority may request evidence of proper performance unless it can obtain the information from databases without significant cost.
- **Switching authorisations:** Before bids are opened, the bidder must have a worker listed in Elektrilevi’s partner portal with valid switching authorisations for work-related switching in the 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energisation and restoration of the normal configuration. This requirement does not cover regional or distribution substations. The authorisations must be obtained in accordance with document J387.
- **Person responsible for work operations:** Before bids are opened, the bidder must have a person responsible for work operations listed in the partner portal. The relevant rights must be obtained in accordance with documents J31 and J3284.
- **Electrical work supervisor:** Before bids are opened, the bidder must have an electrical work supervisor listed in the partner portal, holding valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. The bidder must have evidence of the qualification as of the bid submission date.
- **Bid and representation:** The bid must comply with the procurement documents; conditional bids or bids containing additional conditions are not permitted. The bidder must complete every unit-price field in the price schedule using the prescribed form. It must provide the name, position and contact details of the person or persons authorised to sign the contract, the basis for their authority, and the details of a contact person for contract performance. If signing authority does not arise from the articles of association, a power of attorney must be included.
- **Payment terms:** Standard payment periods from receipt of the invoice are 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
- **Trade secrets:** The bidder must identify any information in its bid that it considers a trade secret and explain why. The bid price and amounts, as well as information used to assess bids, may not be designated as trade secrets.
- **Origin restrictions:** Companies domiciled or established in the Russian Federation or Belarus may not participate. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from either country. The contracting authority may request certificates of origin.
