Compliance requirements
The bidder must not be subject to mandatory exclusion grounds: convictions of the bidder or relevant persons authorised to represent, direct or control it for participation in a criminal organisation, breach of duty of honesty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; convictions relating to illegally employing a foreign national or breaching the conditions for their employment, including paying below the statutory rate; convictions relating to unlawful child labour or human trafficking; or outstanding national tax, payment or environmental-charge liabilities, or tax or social-security contribution debts under the law of the bidder’s country of establishment.
The contracting authority may also exclude a bidder for materially or repeatedly breaching an important term of a previous public contract where this resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about compliance with qualification conditions or failing to provide requested information or documents.
A bidder established in Russia or Belarus is not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. Submit a list stating each contract’s performance period, the other contracting party’s details, including a contact person’s telephone number and email address, and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The bidder must have:
- A worker authorised to carry out switching operations related to the works on 0.22–20 kV networks, excluding regional and distribution substations, and listed in Elektrilevi’s partner portal before bids are opened. For low-voltage works only (0.22–1 kV), low-voltage switching authorisation is sufficient; otherwise, both low- and medium-voltage authorisations are required, including where low-voltage works require switching from the medium-voltage side. Authorisations must follow procedure J387.
- A person designated as responsible for the work operation, listed in the partner portal before bids are opened. The relevant authorisation must follow documents J31 and J3284.
- A person managing electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act, has the required evidence by the bid submission deadline, and is listed in the partner portal before bids are opened.
The bid must accept the tender-document conditions without additions or conditions. Submit the price in the prescribed table and complete every unit-price field. The bid must also identify the contract signatory or signatories, their titles and contact details, and a contact person for contract matters. If signatory authority does not arise from the company’s articles of association, include a power of attorney.
The standard payment period, calculated from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999; 35 days for contracts from EUR 60,000 to EUR 249,999; and 45 days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days.
Materials, equipment and goods used or installed in performing the works, including components, must not be produced in or originate from Russia or Belarus. The contracting authority may request certificates of origin.
