Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if the bidder or a member of its administrative, management or supervisory body, or a person empowered to represent, make decisions for or control it, has a relevant final conviction within the preceding five years, or remains subject to an exclusion period. The listed offences are participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. Exclusion may also apply for failure to pay taxes or social security contributions in the bidder’s country of establishment or the contracting authority’s country. The stated threshold is EUR 0; however, under the notice, the tax authority does not issue a tax-debt certificate where the debt is below EUR 100 (excluding interest not established by an administrative act) or payment has been deferred. Foreign bidders are subject to the rules of their country of establishment. National grounds also include enabling a foreign national staying unlawfully to work, and entering into the contract in a way that would breach an international or Estonian government sanction.

Qualification criteria and exclusion grounds

The bidder, any joint bidders and subcontractors directly performing the contract must have a competent person holding a Level 5 Construction Works Manager professional qualification. The bid must identify that person and state their qualification and professional certificate number; the contracting authority may request written consent from the person to participate in the work. Within the 60 months preceding the start of the procurement, the bidder must have completed at least one similar playground and/or sports-field construction or repair project, duly completed and accepted by the client. The bidder must list the reference project in the procurement passport, including its subject and description, value, contract date and performance period, and the other contracting party’s name and contact details. For a contract awarded through a procurement procedure, provide its reference number as well. The contracting authority will verify the work with the client and recommends including the client’s confirmation with the bid. The bid must be unconditional and confirm acceptance of all procurement-document requirements. Pricing must follow the structure specified in the pricing criteria and be submitted using the separate Appendix 2 pricing table. The bidder must confirm compliance with the procurement documents; where equivalence is relevant, explain it and provide supporting evidence. No specific award criteria are stated in the provided documents; check the procurement documents for details.
