Compliance requirements

The bidder will be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation; breach of the duty of integrity or a corruption offence; fraud; terrorism-related offences; money laundering or terrorist financing; enabling unlawful employment of a foreign national or violating the conditions for a foreign national’s employment in Estonia, including paying below the statutory wage rate; or unlawful use of child labour or human trafficking. A bidder with outstanding national tax, duty or environmental charge arrears, or tax or social security contribution debts under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder that has seriously or persistently breached an essential term of a previous public contract, resulting in termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or failed to provide that information or requested additional documents. Businesses established in the Russian Federation or the Republic of Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction work similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have been worth EUR 40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including the client representative’s telephone number and email address), and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can retrieve it from databases without significant cost. The bidder’s team must include: - A person with valid switching rights for the switching operations required for the work in the 0.22–20 kV electricity network, excluding regional and distribution substations. For low-voltage-only work (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The person must be registered in Elektrilevi’s partner portal by the applicable tender deadline; the rights are to be obtained in accordance with instruction J387. - A person designated as responsible for the work operation, registered in Elektrilevi’s partner portal before the tender submission deadline. The relevant rights are governed by instructions J31 and J3284. - A person leading the electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act, has the relevant evidence by the tender submission date, and is registered in Elektrilevi’s partner portal before the deadline. The tender must be unconditional and comply with the procurement documents. The bidder must submit a price table using the prescribed form and complete every unit-price field, taking account of the completion instructions in control-system document V178. The bidder must identify the contract signatory or signatories and provide their names, titles and contact details, as well as the contract-performance contact person’s details. A power of attorney must be included if signing authority does not arise from the articles of association. The contracting authority’s standard payment periods, calculated from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999; 35 days for contracts from EUR 60,000 to EUR 249,999; and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must identify and justify any information claimed as a trade secret. The tender price and price components, as well as specified figures or indicators used to assess tenders, may not be designated as trade secrets. The provided documents do not state an award criterion.
