Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must not have mandatory exclusion grounds. These include relevant convictions of the bidder or persons authorised to represent, direct or control it for participation in a criminal organisation, breach of integrity duties or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; facilitating unlawful employment or breaches of conditions for employing foreign nationals in Estonia, including paying below the statutory rate; and unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding national tax, levy or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The buyer may also exclude a bidder for substantial or persistent breaches of important terms of earlier public contracts that resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about compliance with qualification requirements or failing to provide that information or requested supporting documents. Businesses established in Russia or Belarus may not participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have had a value of €40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including a client representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the buyer can obtain it from a database without significant cost. The team must include a person with valid switching rights for the switching operations required for the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. For low-voltage works only (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where medium-voltage-side switching is needed for low-voltage works. The person must be registered in Elektrilevi’s partner portal before bids are opened; the switching-rights application must follow procedure J387. The team must also include a person designated as responsible for the work operation, registered in the partner portal by the bid submission deadline; the relevant rights must follow documents J31 and J3284. A person leading the electrical works must have valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act, hold the relevant evidence when submitting the bid, and be registered in the partner portal by the submission deadline. The bid must comply with the procurement documents, and conditional bids or bids with additional conditions are not permitted. Submit the price using the prescribed table and complete every unit-price field, taking account of the instructions in document V178. Provide the name, position and contact details of the contract signatory or signatories and a contract-performance contact. If signing authority does not arise from the articles of association, include a power of attorney. The buyer’s standard payment periods from receipt of the invoice are 14 calendar days for contracts up to €59,999, 35 days for contracts from €60,000 to €249,999, and 45 days for contracts of €250,000 or more. Participation in the buyer’s factoring programme results in a 95-calendar-day payment period. Identify and justify any trade secrets; the price and price components, and other evaluation-related indicators that may not be treated as trade secrets, must not be designated as such. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; the buyer may request certificates of origin.
