Compliance requirements
A bidder may be excluded for relevant final convictions involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour, or human trafficking, where the conviction concerns the bidder or a person in its management or with authority to represent or control it and was imposed within the previous five years or the exclusion period remains in force. Other grounds include unpaid taxes or social security contributions; insolvency, bankruptcy, liquidation, creditor arrangements, or suspended business; serious professional misconduct; agreements intended to distort competition; an unavoidable conflict of interest; involvement in preparing the procurement that creates an advantage that cannot otherwise be prevented; serious or repeated breaches of previous contracts resulting in early termination, damages, price reduction, or penalties; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the decision. Grounds also include breaches of environmental, social, or labour-law obligations, enabling a person without lawful status to work, being subject to international sanctions, and conviction for tax offences. Where legally permitted, the bidder may provide evidence of measures taken to restore its reliability.
