Compliance requirements
The contracting authority will exclude a bidder if the bidder or a relevant representative or governing-body member has been convicted of participation in a criminal organisation, breach of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the employment of a foreign national without legal grounds or breaches of the conditions for employing foreign nationals in Estonia, including underpayment; or illegal use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding national taxes, duties or environmental charges, or tax or social-security debts under the law of its country of establishment, or is subject to an international sanction, unless awarding the contract would not breach that sanction.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation or a comparable situation; serious professional misconduct; anti-competitive agreements or coordinated conduct; an unmanageable conflict of interest; an unfair competitive advantage resulting from involvement in preparing the procurement; serious or repeated breach of an earlier public contract; false or withheld information about qualification or requested documents; attempts to improperly influence the contracting authority or obtain confidential information, or negligent misleading statements; convictions for tax offences; or lack of the legal right to submit a bid.
Qualification criteria and exclusion grounds
The bidder must meet these requirements, which apply to all lots:
- Financial capacity: Net turnover must have been at least EUR 200,000 in each of the bidder’s last three completed financial years. Submit extracts from the annual accounts showing turnover for those years, unless the information for an Estonian-registered legal entity is publicly available to the contracting authority. If the financial year differs from the calendar year, the requirement applies to the last three completed financial years. At least six months must have elapsed since the end of the latest completed financial year as of the bid submission date.
- Similar experience: In the 60 months before commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to this procurement. At least one contract must have been worth EUR 80,000 or more, excluding VAT. Submit a list stating the performance period, the other contracting parties’ details (including the client representative’s telephone number and email address), and procurement reference numbers where applicable. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant cost.
- The team must include a person responsible for managing electrical works who holds valid A-class competence and/or a qualification of at least level 6 under the Professions Act, has the corresponding evidence, and is registered in Elektrilevi’s partner portal before the bid deadline.
- For switching operations associated with the works in the 0.22–20 kV electricity network, the bidder must have an employee with switching rights, registered in Elektrilevi’s partner portal before bid opening. Switching rights must cover operational switching, isolation and earthing, re-energisation, and restoration of the normal configuration, except in regional and distribution substations. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The applicable training procedure is specified in document J387.
- The bidder must have a person appointed as responsible for the work operation (C-person), registered in Elektrilevi’s partner portal before the bid deadline. The applicable requirements are described in documents J31 and J3284.
- Submit the completed price table using the prescribed form, filling in every unit-price field. The bid must be unconditional and accept all tender-document requirements. Its preparation must also take account of the instructions for completing Elektrilevi control-system document V178.
- Provide the name, position and contact details of the contract signatory or signatories and of the contact person for contract-performance matters. If signing authority does not derive from the articles of association, include a power of attorney.
- The contracting authority’s standard payment periods, counted from receipt of the invoice, are 14 calendar days for contract values up to EUR 59,999; 35 calendar days for values from EUR 60,000 to EUR 249,999; and 45 calendar days for values of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
- Identify any information in the bid claimed as a trade secret and give reasons. The bid price, component prices and other indicators used in evaluation may not be designated as trade secrets.
- The bidder must confirm that its registered or place of residence is not in the Russian Federation or the Republic of Belarus. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from either country; the contracting authority may request certificates of origin.
