Compliance requirements
The bidder may be excluded for relevant final convictions within the previous five years involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or suspended business activity; serious professional misconduct; breaches of environmental, social or labour obligations; anti-competitive agreements; an unresolved conflict of interest or an advantage gained through involvement in preparing the procurement; and significant or repeated failures under previous public contracts resulting in early termination, damages, price reductions or penalties. Exclusion may also apply for false or misleading information, withholding required information or documents, improper attempts to influence the procurement, or seeking confidential information for an unfair advantage. National grounds include enabling a person without lawful status to work, being subject to applicable international sanctions, and relevant tax-related convictions. The notice also provides for declarations concerning these grounds and, where permitted, evidence of measures taken to restore reliability.
